It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Chapter 16-21 of the General Laws entitled "Health and Safety of Pupils" is |
2 | hereby amended by adding thereto the following section: |
3 | 16-21-5.1. Carbon monoxide detectors required in school buildings. |
4 | Effective January 1, 2019, all school buildings where students are in attendance for any |
5 | portion of the day shall be required to have carbon monoxide detectors installed and maintained |
6 | therein, in accordance with the applicable provisions of the National Fire Protection Association |
7 | ("'NFPA") Code and the state fire safety code ('"state code"), chapter 28.1 of title 23. The fire |
8 | safety code board of appeal and review (the "board'') established pursuant to chapter 28.3 of title |
9 | 23 shall have authority to promulgate rules and regulations necessary to enforce the provisions of |
10 | this section. Provided, in the event the state fire marshal determines that neither the NFPA code |
11 | nor the state code have provisions in place to govern such installation, then the state fire marshal |
12 | may use the provisions of NFPA Code 72, 2010 edition, NFPA Code 720, 2012 edition, the state |
13 | fire code, and any additional requirements provided under those codes for licensed nursery or day |
14 | care services, as guidance in the installation of carbon monoxide detectors in schools, until such |
15 | time as the board promulgates applicable rules and regulations. |

17 | SECTION 2. This act shall take effect upon passage. |

1 | This act would require that effective January 1, 2019, all school buildings where students |
2 | are in attendance would be required to have carbon monoxide detectors installed and maintained |
3 | therein. The act would also authorize the fire safety code board of appeal and review to |
4 | promulgate rules and regulations to enforce the provisions of this requirement. |
5 | This act would take effect upon passage. |
