RELATING TO EDUCATION -- ESTABLISHMENT OF CHARTER PUBLIC SCHOOLS

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 16-77 of the General Laws entitled "Establishment of Charter

Public Schools [See Title 16 Chapter 97 - The Rhode Island Board of Education Act]" is hereby

amended by adding thereto the following section:

     16-77-13. Sending districts to have membership on board of directors.

     Effective July 1, 2018, charter public schools as defined in §16-77-2.1(4) shall include on

their board of governors or trustees one school committee member or their designee as appointed

by the respective school committees from each school district that comprises five percent (5%) or

more of the total number of students, as defined in § 16-7-22(1), enrolled in the charter public

school. In the event a charter public school does not have a board of governors, trustees, or

similar body, such a body shall be established by each charter public school or organization to

ensure public representation in the supervision of the public charter school including, but not

limited to, the expenditure of public resources. Members of the board appointed pursuant to this

section shall have a term equal to that of the state fiscal year. For purposes of determining the

authorization to appoint a member pursuant to this section the enrollment of students for the prior

fiscal year of the appointment shall be used.

     SECTION 2. This act shall take effect July 1, 2018.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

OF

RELATING TO EDUCATION -- ESTABLISHMENT OF CHARTER PUBLIC SCHOOLS

     This act would require school committees to appoint one designee to the board of

directors of the governing body of any charter public school where students who are residents of

the school committee's district comprise at least five percent (5%) of the student body at the

charter public school.

     This act would take effect July 1, 2018.
