RELATING TO BUSINESSES AND PROFESSIONS - PHARMACIES--PARTIAL FILLS | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Chapter 5-19.1 of the General Laws entitled "Pharmacies" is hereby |
2 | amended by adding thereto the following section: |
3 | 5-19.1-33. Partial fill of Schedule II controlled substance. |
4 | (a) A pharmacist may dispense a Schedule II controlled substance, as listed in § 21-28- |
5 | 2.08, as a partial fill if requested by the patient or the prescriber. |
6 | (b) If a pharmacist dispenses a partial fill on a prescription pursuant to this section, the |
7 | pharmacy shall retain the original prescription, with a notation of how much of the prescription |
8 | has been filled, until the prescription has been fully dispensed. The total quantity dispensed shall |
9 | not exceed the total quantity prescribed. |
10 | (c) Subsequent fills, until the original prescription is completely dispensed, shall occur at |
11 | the pharmacy where the original prescription was partially filled. The full prescription shall be |
12 | dispensed not more than thirty (30) days after the date on which the prescription was written. |
13 | Thirty-one (31) days after the date on which the prescription was written, the prescription shall |
14 | expire and no more of the drug shall be dispensed without a subsequent prescription. |
15 | (d) The pharmacist shall record in the prescription-drug-monitoring-program maintained |
16 | by the department of health pursuant to § 21-28-3.18 only the actual amounts of the drug |
17 | dispensed. |
18 | (e) The pharmacist shall record the date and amount of each partial fill in a readily |
19 | retrievable form and on the original prescription, and shall include the initials of the pharmacist |

1 | who dispensed each partial fill. |
2 | (f) This section is not intended to conflict with or supersede any other requirement |
3 | established for the prescription of a Schedule II controlled substance. |
4 | (g) For purposes of this section, the following definitions apply: |
5 | (1) "Original prescription" means the prescription presented by the patient to the |
6 | pharmacy or submitted electronically to the pharmacy. |
7 | (2) "Partial fill" means a part of a prescription filled that is of a quantity less than the |
8 | entire prescription. |
9 | SECTION 2. This act shall take effect upon passage. |
