RELATING TO CRIMINAL PROCEDURE - ARREST | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Section 12-7-9 of the General Laws in Chapter 12-7 entitled "Arrest" is |
2 | hereby repealed. |
3 | 12-7-9. Conditions justifying force dangerous to life. |
4 | A police officer may use force dangerous to human life to make a lawful arrest for |
5 | committing or attempting to commit a felony, whenever he or she reasonably believes that force |
6 | dangerous to human life is necessary to effect the arrest and that the person to be arrested is aware |
7 | that a peace officer is attempting to arrest him or her. |
8 | SECTION 2. This act shall take effect upon passage. |
