RELATING TO LABOR AND LABOR RELATIONS -- HOISTING ENGINEERS | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Section 28-26-7 of the General Laws in Chapter 28-26 entitled "Hoisting |
2 | Engineers" is hereby amended to read as follows: |
3 | 28-26-7. Application for license -- Examination. |
4 | (a) Each person who desires to act as a steam, internal combustion engines, electric, or |
5 | compressed air hoisting engineer shall make application to the division for a license upon a form |
6 | furnished to him or her, submit a notarized list of work experience, have possessed for at least |
7 | three (3) years prior to filing of the application, a certificate of registration in full force and effect |
8 | from the department of labor and training specifying that person as a registered apprentice |
9 | hoisting engineer; provided further, the application of that applicant shall include an affidavit or |
10 | affidavits of their employer or former employers or other reasonably satisfactory evidence |
11 | showing that the applicant has actually been engaged in hoisting work as an apprentice hoisting |
12 | engineer in the state of Rhode Island for six thousand (6,000) hours of on the job training during a |
13 | three (3) year period, which shall include the successful completion of four hundred thirty-two |
14 | (432) hours of related instruction at a training program recognized by the department of labor and |
15 | training, and shall pass an examination on the construction and operation of steam, electric, |
16 | internal combustion engines, and compressed air engines and machinery. Provided, however, the |
17 | apprenticeship requirement herein shall not apply to restricted licenses, aerial lifts, and hoisting |
18 | equipment used in the assembly of elevators. Applications for examinations must be received |
19 | fifteen (15) working days prior to the examination date. |

1 | (b) Any person applying for a license and who knowingly makes any misstatement as to |
2 | his or her work experience or other qualifications shall be subject to the penalties provided for in |
3 | ยง 28-26-11. |
4 | (c) In addition to the requirements for submitting an application for examination, as |
5 | required in subsection (a) above, any person applying for a full license, a hydraulic crane license, |
6 | or a lattice crane license shall also be required to include a valid medical health card with their |
7 | application. A separate notarized statement shall also be attached to the application, and shall |
8 | contain all work related experience, including all equipment trained on and/or operated. |
9 | (d) In addition to the requirements for submitting an application for examination, as |
10 | required in subsection (a) above, any person applying for a construction forklift license or a full |
11 | license shall also be required to include a copy of their OSHA forklift certification with their |
12 | application. |
13 | SECTION 2. This act shall take effect upon passage. |
