A N   A C T

RELATING TO LABOR AND LABOR RELATIONS - MINIMUM WAGES

     

     Introduced By: Representatives Shanley, Shekarchi, Williams, Lyle, and Barros

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 28-12 of the General Laws entitled "Minimum Wages" is hereby

amended by adding thereto the following section:

     28-12-3.3. Minimum wages for employees of developmental disabilities

4

organizations.

     (a) Commencing July 1, 2019, every covered employer providing services to five (5) or

6

more persons with developmental disabilities, that are reimbursed for such services by the state,

7

shall pay each of their employees, no less than thirteen dollars and seventy seven cents ($13.77)

8

per hour. Commencing July 1, 2020, every covered employer providing services to five (5) or

9

more persons with developmental disabilities, that are reimbursed for such services by the state,

10

shall pay of their employees, no less than fifteen dollars ($15.00) per hour. For the purposes of

11

this section, covered employers are those developmental disability organizations licensed to

12

provide services pursuant to § 40.1-24-3.

     (b) Appropriation. The state general revenues and federal funds appropriation(s) to the

14

department of behavioral heathcare, developmental disabilities, and hospitals for services for the

15

developmentally disabled shall increase to programs that provide services to adults with

16

developmental disabilities in order to adjust to the minimum wage increase enacted in § 28-12-

17

3.3.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would require certain employers who provide services to people with

2

developmental disabilities to pay their employees no less than thirteen dollars and seventy seven

3

cents ($13.77) per hour commencing July 1, 2019 and fifteen dollars ($15.00) per hour

4

commencing on July 1, 2020. This wage increase shall be funded by increased appropriation(s) to

5

the department of behavioral healthcare, developmental disabilities, and hospitals.

6

     This act would take effect upon passage.
