RELATING TO CRIMINAL OFFENSES -- ASSAULTS | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Chapter 11-5 of the General Laws entitled "Assaults" is hereby amended by |
2 | adding thereto the following section: |
3 | 11-5-18. Assault on a person with a developmental disability. |
4 | Any person who shall commit an assault or battery on any person with a developmental |
5 | disability as defined in ยง 40.1-1-8.1 shall be deemed to have committed a felony and shall be |
6 | punished by imprisonment for not more than five (5) years and a fine of not more than one |
7 | thousand dollars ($1,000), or both. |
8 | SECTION 2. This act shall take effect upon passage. |
