A N   A C T

RELATING TO EDUCATION -- RIGHTS AND DUTIES OF TEACHERS GENERALLY

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 16-12 of the General Laws entitled "Rights and Duties of Teachers

Generally" is hereby amended by adding thereto the following section:

     16-12-12. Cardiopulmonary resuscitation training for teachers.

     (a) The department of elementary and secondary education shall develop and prescribe a

5

cardiopulmonary resuscitation (CPR) training course for public school teachers in the state. The

6

course shall be established in accordance with the requirements and criteria obtained from the

7

American Heart Association or the American Red Cross and the director of the department of

8

health. All teachers shall be certified in cardiopulmonary resuscitation (CPR).

     (b) In accordance with the provisions of ยง 9-1-34, no teacher who renders emergency

10

assistance in the nature of cardiopulmonary resuscitation to a person in need thereof, shall be

11

liable for civil damages for any personal injuries which result from acts or omissions by such

12

persons rendering the emergency care, which may constitute ordinary negligence; provided,

13

however, that this immunity applies only to persons who have been trained in accordance with

14

standards promulgated by either the American Heart Association or the American Red Cross.

This immunity does not apply to acts or omissions constituting gross, willful, or wanton

16

negligence. This immunity shall also extend to persons providing approved training in

17

cardiopulmonary resuscitation in accordance with standards promulgated by either the American

18

Heart Association or the American Red Cross.

     SECTION 2. This act shall take effect on January 1, 2020.

     This act would require that teachers be trained and certified in cardiopulmonary
