RELATING TO HEALTH AND SAFETY - EXPLOSIVES - NOTICE

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 23-28.28-37 of the General Laws in Chapter 23-28.28 entitled

"Explosives" is hereby amended to read as follows:

     23-28.28-37. Notice to adjoining landowners.

     (a) Prior to the commencement of blasting operations, any person, firm, corporation, or

5

other entity that is regulated pursuant to the provisions of this chapter shall notify the owner or

6

owners of record of any improved real property within five hundred (500') feet, as measured from

7

the nearest borehole to the closest improved real property, of an intended blast or detonation,

8

excluding road, bridge, utility, and public works construction, no less than twenty-four (24) hours

9

prior to the blast or detonation.

     (b) Notice shall also be given to any owner or owners of real property on which a

11

structure is located, which structure is located within five hundred feet (500') of the property line

12

of the property on which the blasting is to take place, and to the city or town council of the

13

municipality within which such property is located, no less than fourteen (14) days prior to the

14

blast or detonation. Quarries and mines authorized to operate shall be exempt from the

15

requirements of this subsection.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would expand the notice requirements relating to the use of explosives by

requiring two (2) weeks' notice of blasting to the municipality and to owners of structures within

3

five hundred feet (500') of the mutual property line.

     This act would take effect upon passage.
