RELATING TO HEALTH AND SAFETY -- REFUSE DISPOSAL | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Chapter 23-18.9 of the General Laws entitled "Refuse Disposal" is hereby |
2 | amended by adding thereto the following section: |
3 | 23-18.9-9.3. Location of waste management facilities. |
4 | (a) The general assembly recognizes and declares that disposal of solid waste in or near |
5 | residential neighborhoods is not an environmentally sound solid waste management practice, and |
6 | that such disposal could threaten the public health with contamination of the environment. |
7 | (b) Solid waste landfill facilities and municipal waste management facilities shall be |
8 | prohibited and shall not be located closer than one mile from any residential neighborhood in any |
9 | city or town. |
10 | SECTION 2. This act shall take effect upon passage. |
