RELATING TO CRIMINAL PROCEDURE -- SEARCH WARRANTS | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Chapter 12-5 of the General Laws entitled "Search Warrants" is hereby |
2 | amended by adding thereto the following section: |
3 | 12-5-11. Sealing of search warrant. |
4 | The clerk of any court receiving an application for the issuance of a search warrant shall |
5 | seal the application and all related records and orders until such time as charges are brought |
6 | against any individual or entity pursuant to or with respect to such warrant, unless the court |
7 | issuing the warrant issues an order granting an individual or entity relief from the seal upon good |
8 | cause shown, including an assertion that the record is necessary for the preparation of a defense |
9 | by the person or entity charged. |
10 | SECTION 2. This act shall take effect upon passage. |
