A N   A C T

RELATING TO AGRICULTURE AND FORESTRY

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 2-20-1 of the General Laws in Chapter 2-20 entitled "Lumber

Surveys" is hereby repealed.

     2-20-1. Appointment of city and town surveyors and measurers.

     The city and town councils of all cities and towns where boards, plank, timber, joist and

scantling are imported for sale shall annually, on or before the first day of March, appoint one or

more surveyors and measurers of boards, plank, timber, joist and scantling, who are removable at

the pleasure of the council. Each surveyor shall give bond, with two (2) securities, in the sum of

five hundred dollars ($500), to the city or town treasurer for the faithful discharge of the duties of

the office.

     SECTION 2. Section 4-15-2 of the General Laws in Chapter 4-15 entitled "Animals at

Large" is hereby repealed.

     4-15-2. Appointment of field drivers.

     The town and city councils of the several towns and cities may appoint one or more field

drivers for their cities and towns, with the same power to impound animals as the freeholders and

qualified voters of the cities and towns.

     SECTION 3. Section 5-8.1-18 of the General Laws in Chapter 5-8.1 entitled "Land

Surveyors" is hereby repealed.

     5-8.1-18. Board of registration for professional land surveyors -- Public works.

     This state and its political subdivisions, such as county, city, town or legally constituted

board, districts, commissions, or authorities, shall not engage in the practice of land surveying

involving either public or private property without the surveying being under the direct charge

and supervision of a land surveyor registered under this chapter.

     SECTION 4. Sections 21-15-1 and 21-15-2 of the General Laws in Chapter 21-15

entitled "Pickled Fish" are hereby repealed.

     21-15-1. Duties of packers.

     In every city or town in which pickled fish are packed for sale or exportation from the

state, the packers of every city or town shall see that the fish have been properly pickled and that

they are properly repackaged in casks, in good shipping order, with good salt sufficient in each

cask to preserve the fish from damage in transportation to any foreign port.

     21-15-2. Packer's bond.

     Every packer shall give bond to the city or town treasurer of the city or town in which the

packer shall be appointed, in the sum of one thousand dollars ($1,000), with sufficient surety or

sureties to the satisfaction of the city or town treasurer, for the faithful performance of the duties

of his or her office.

     SECTION 5. Section 46-10-1 of the General Laws in Chapter 46-10 entitled

"Shipwrecks" is hereby repealed.

     46-10-1. Appointment of town commissioners of wrecks and shipwrecked goods --

Bond.

     The town council of every town, the territorial limits of which extend to the seashore,

except the town of New Shoreham, shall annually appoint a commissioner of wrecks and

shipwrecked goods, with power to appoint one or more deputies. Every commissioner of wrecks

and shipwrecked goods shall give bond with sufficient surety or sureties to the town treasurer of

the town wherein the commissioner shall be appointed, in the sum of five thousand dollars

($5,000) for the faithful performance of the duties of the commissioner's office.

     SECTION 6. Chapter 47-7 of the General Laws entitled "Public Weighers" is hereby

repealed in its entirety.

CHAPTER 47-7

Public Weighers

     47-7-1. Appointment of public weighers -- Fees.

     The town councils of the several towns and the city council of any city shall appoint one

or more persons to be weighers of coal and other articles of merchandise, who shall be sworn and

be removable at the pleasure of the town or city council appointing them, and shall receive such

fees as may be fixed by the town or city council of the several towns or cities, which shall be paid

by the seller; provided, that no person shall act as a public weigher of coal or other merchandise

of which he or she is either the buyer or seller, or in the sale whereof he or she has any interest.

     47-7-2. Sale of merchandise without certificate from weigher.

     Every person who shall sell coal or other merchandise without its being first weighed by

a weigher provided for in § 47-7-1, when the weighing shall be demanded by the purchaser, and

procuring a certificate of the weight for the purchaser, shall be fined twenty dollars ($20.00) for

each offense.

     SECTION 7. Section 47-12-2 of the General Laws in Chapter 47-12 entitled "Firewood

and Charcoal" is hereby repealed.

     47-12-2. Cording fees.

     Every person chosen by a town to be a corder of wood shall receive for cording and

measuring not exceeding twelve cents (12¢) per cord, to be paid by the purchaser of the wood.

     SECTION 8. This act shall take effect upon passage.

     This act would eliminate the need for city and town councils to appoint certain positions

that are no longer necessary because of their antiquated duties.

     This act would take effect upon passage.
