RELATING TO MOTOR VEHICLES - MISSING TITLES FOR OLDER VEHICLES

     

     Introduced By: Senators Quezada, Cano, Nesselbush, Picard, and Metts

     Referred To: Senate Special Legislation and Veterans Affairs

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 31-3.1-38 of the General Laws in Chapter 31-3.1 entitled

"Certificates of Title and Security Interests" is hereby amended to read as follows:

     31-3.1-38. Effective dates -- Applicability.

     This chapter shall apply to all model vehicles designated as 2001 models and all

5

subsequent model year vehicles. All vehicles designated as model years prior to 2001 shall be

6

excluded from these provisions, provided that no title certificate shall be required once a vehicle

7

is twenty (20) years old. Provided, however, that for all vehicles that are older than ten (10) years,

8

but less than twenty (20) years old, and whose title certificate cannot be located, the owner may

9

apply for a registration certificate pursuant to ยง 31-6-1(a)(13) which should state that the vehicle

10

is at least ten (10) years old and identify the current registered owner of that vehicle for a fee of

11

fifty dollars ($50.00).

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would allow the owner of a vehicle that cannot locate a certificate of title for

2

their vehicle, which is over ten (10) years, but less than twenty (20) years old to apply for a

3

registration certificate which would state that the vehicle is at least ten (10) years old and identify

4

the current registered owner(s) of that vehicle for a fifty dollar ($50.00) fee.

5

     This act would take effect upon passage.
