A N   A C T

RELATING TO EDUCATION - HEALTH AND SAFETY OF PUPILS

     

     Introduced By: Senators Quezada, Pearson, Valverde, Bell, and Euer

     Date Introduced: February 13, 2019

     Referred To: Senate Education

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 16-21 of the General Laws entitled "Health and Safety of Pupils" is

hereby amended by adding thereto the following section:

     16-21-37. Possession of feminine hygiene products.

     (a) A student, while on school property or at a school-related event or activity, may

5

possess and use over-the-counter products to treat menstrual cramps or vaginal yeast infections

6

without a physician's or parent's note.

7

     (b) Nothing in this section shall make the school district or its personnel liable for any

8

damages under this section.

     (c) The school district may encourage schools to educate pupils on the safe use of over-

10

the-counter medications.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would permit students to possess and use over-the-counter products to treat

menstrual cramps or vaginal yeast infections during school activities without a doctor's or parent's

3

note. It would authorize the school district to encourage schools to educate pupils on the safe use

4

of such products, but shall not hold the school district or its personnel liable for any damages.

5

     This act would take effect upon passage.
