A N   A C T

RELATING TO CRIMINAL OFFENSES - DUELING AND FIGHTING

     Introduced By: Senators Paolino, Pearson, de la Cruz, and Lynch Prata

     Date Introduced: February 13, 2019

     Referred To: Senate Judiciary

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 11-12-4 of the General Laws in Chapter 11-12 entitled "Dueling

and Fighting" is hereby repealed.

     11-12-4. Seconding fatal duel outside state.

     Every person being an inhabitant of or resident in this state who shall, by previous

appointment or engagement made within this state, be the second of either party in any duel as is

mentioned in § 11-12-3 and shall be present as the second when the mortal wound is inflicted, of

which death shall ensue within this state, shall be deemed to be an accessory before the fact to the

crime of murder within this state, and may be indicted or charged by information, tried, convicted

and sentenced within the county where the death shall happen.

     SECTION 2. This act shall take effect upon passage.

     This act would repeal § 11-12-4 of the general laws that prohibits a person from being a

second at a duel that results in the infliction of a mortal wound.

     This act would take effect upon passage.
