	RELATING TO PUBLIC UTILITIES AND CARRIERS -- TRANSPORTATION NETWORK
	COMPANY SERVICES

	It is enacted by the General Assembly as follows:
1	SECTION 1. Section 39-14.2-3 of the General Laws in Chapter 39-14.2 entitled
2	"Transportation Network Company Services" is hereby amended to read as follows:
3	39-14.2-3. Powers of division.
4	(a) Every person operating a licensed transportation network company or operating as a
5	licensed transportation network company operator except for those operating in the town of New
6	Shoreham is declared to be subject to the jurisdiction of the division of public utilities and
7	carriers. The division may prescribe rules and regulations consistent with this chapter that are
8	necessary to assure adequate, safe, and compliant service under this chapter. The division is
9	further authorized to conduct investigations into complaints; conduct investigations initiated on
10	its own; and to hold hearings as it deems necessary to fulfill the proper administration of this
11	chapter.
12	(b) The division shall require transportation network companies to establish and
13	implement a written policy capping dynamic pricing during disasters and relevant states of
14	emergency and make this policy available on its website or application.
15	SECTION 2. Chapter 39-14.2 of the General Laws entitled "Transportation Network
16	Company Services" is hereby amended by adding thereto the following section:
17	39-14.2-18.1. Regulation by the town of New Shoreham.
18	Notwithstanding the provisions of § 39-14.2-18, the town of New Shoreham shall have

1	the authority to establish reasonable regulations governing TNC operators offering TNC services
2	in New Shoreham through proper adoption of town ordinance or by entering into operating
3	agreements with TNCs.
4	SECTION 3. This act shall take effect upon passage.

1	This act would exempt the town of New Shoreham from the jurisdiction of the division of
2	public utilities and carriers for purposes of regulating transportation network companies, and
3	would allow the town to establish its own regulatory framework regarding transportation network
4	company services.
5	This act would take effect upon passage.
