	RELATING TO CRIMINAL OFFENSES - WEAPONS

	It is enacted by the General Assembly as follows:
1	SECTION 1. Section 11-47-23 of the General Laws in Chapter 11-47 entitled "Weapons"
2	is hereby amended to read as follows:
3	11-47-23. False information in securing firearm or license. False information in
4	securing firearm or license – Straw purchasers.
5	(a) No person shall, in purchasing or otherwise securing delivery of a shotgun, rifle,
6	pistol, or revolver firearm, or in applying for a license or permit to carry it, give false information
7	or offer false evidence of his or her identity. Violation of the provisions of this section may be
8	punished by a fine of not more than five thousand dollars ($5,000), imprisonment for not more
9	than five (5) years, or both.
10	(b) No person shall knowingly purchase or otherwise obtain a firearm on behalf of
11	another person, or transfer a firearm to another person, whom the transferor knows or reasonably
12	should know is prohibited from possessing a firearm under federal or state law.
13	(c) A first violation of the provisions of this section may be punished by a fine of not
14	more than five thousand dollars ($5,000), imprisonment for not more than five (5) years, or both.
15	A second or subsequent violation of the provisions of this section may be punished by a fine of
16	not more than ten thousand dollars ($10,000), imprisonment for not less than two (2) years nor
17	more than ten (10) years, or both.

1	This act would prohibit obtaining a firearm on behalf of another person if that person is
2	prohibited from possessing a firearm. This act would also increase the penalties for purchases of
3	firearms by use of false information.
4	This act would take effect upon passage.
