RELATING TO MOTOR AND OTHER VEHICLES -- DEALERSHIPS

     

     Introduced By: Representatives Azzinaro, Corvese, Knight, Costantino, and Vella-
Wilkinson

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 31-4-11 of the General Laws in Chapter 31-4 entitled "Transfer of

Vehicles" is hereby amended to read as follows:

     31-4-11. Sale of automobiles -- Required equipment.

     (a) No automobile shall be sold, whether new or used, by a dealer, at wholesale or retail,

5

unless the automobile is equipped with a spare tire and a jack, both of which must be functional

6

and operational. The provisions of this section shall not apply:

     (1) To an automobile equipped with tires that without any tire air inflation permit vehicle

8

operation for at least fifty (50) miles at speeds up to at least fifty-five (55) miles per hour; or

9

     (2) An automobile equipped with a factory installed tire repair and inflation system.

10

     (b) A violation of this section (a) of this section shall constitute a misdemeanor.

11

     (c) For each sale of a new or used vehicle by a dealer, the dealer shall provide a written

12

disclosure that the vehicle has a spare tire and jack or the vehicle is equipped with one of the

13

exceptions to a spare tire and jack as provided in this section. There shall be a civil penalty of

14

fifty dollars ($50.00) for a violation under this subsection.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would require motor vehicle dealers to disclose in writing that a vehicle being

2

sold has a spare tire and jack or is otherwise equipped in compliance with applicable law. There

3

shall be a civil penalty of fifty dollars ($50.00) for a violation under this subsection.

4

     This act would take effect upon passage.
