A N   A C T

RELATING TO LABOR AND LABOR RELATIONS – MINIMUM WAGES

     

     Introduced By: Representatives Shekarchi, Edwards, Noret, Serodio, and Amore

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 28-12-9 of the General Laws in Chapter 28-12 entitled "Minimum

Wages" is hereby repealed.

     28-12-9. Workers with disabilities.

     The director of labor and training may provide by regulation, after a public hearing at

5

which any person may be heard, for the employment in any occupation at wages lower than the

6

wage rates applicable under this chapter of individuals whose earning capacity is impaired by

7

physical or mental disability as he or she may find appropriate to prevent curtailment of

8

opportunities for employment, to avoid undue hardship, and to safeguard the applicable wage

9

rates under this chapter. No employee shall be employed at wages fixed pursuant to this section

10

except under a special license issued under applicable regulations of the director of labor and

11

training.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would repeal § 28-12-9 of the general laws which provides that the director of

2

labor and training may approve of wages below the minimum wage for those persons whose

3

earning capacity is impaired due to physical or mental disability.

4

     This act would take effect upon passage.
