RELATING TO HIGHWAYS -- MAINTENANCE OF TOWN HIGHWAYS-- | |
CONSTRUCTION AND MAINTENANCE OF STATE ROADS | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Chapter 24-5 of the General Laws entitled "Maintenance of Town |
2 | Highways" is hereby amended by adding thereto the following section: |
3 | 24-5-7.1. Contractors' insurance. |
4 | Any contractor performing construction services for the maintenance and repair of the |
5 | highways and bridges located within a city or town shall be required to provide insurance |
6 | coverage solely with respect to vehicles used in the rendering of the highway construction |
7 | services and not for any vehicles not participating or utilized in the provision of highway |
8 | construction services. |
9 | SECTION 2. Chapter 24-8 of the General Laws entitled "Construction and Maintenance |
10 | of State Roads" is hereby amended by adding thereto the following section: |
11 | 24-8-12.1. Contractors' insurance. |
12 | (a) The person or contractor whose proposal or bid is accepted by the department of |
13 | administration shall be required to provide insurance coverage solely with respect to vehicles |
14 | used in the rendering of the highway construction services and not for any vehicles not |
15 | participating in the provision of highway construction services. |
16 | (b) The provisions of subsection (a) of this section shall apply to any contracts entered |
17 | into between the department of transportation and the Rhode Island turnpike and bridge authority |
18 | pursuant to ยง 24-12-9. |

1 | This act would allow any contractor performing highway construction services to the |
2 | state, any municipality or the Rhode Island turnpike and bridge authority (RITBA) to provide |
3 | insurance coverage solely for vehicles used in rendering the construction services as opposed to |
4 | any vehicles not used in those operations. |
5 | This act would take effect upon passage. |
