RELATING TO MILITARY AFFAIRS AND DEFENSE -- RHODE ISLAND VETERANS'

HOME

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 30-24-6 of the General Laws in Chapter 30-24 entitled "Rhode

Island Veterans' Home" is hereby amended to read as follows:

     30-24-6. Acceptance of gifts -- Veterans' home restricted account.

4

     (a) The director of human services is hereby authorized and empowered to take and

5

receive in the name of the state any grant, devise, gift, or bequest of real or personal property that

6

may be made for the use and benefit of the Rhode Island veterans' home or the residents or

7

purposes thereof. All money so received, and all money received under the provisions of §§ 30-

8

24-9 and 30-24-10, shall be paid over to the general treasurer and shall be kept by him or her as a

9

restricted account to be known as the "veterans' home restricted account". Use of the "veterans'

10

home restricted account" funds may only be made upon prior approval of the house of

11

representatives' finance committee and senate finance committee. The director may sell and

12

dispose of any real or personal property received under this section, and any property received

13

under § 30-24-9, and the proceeds of the sale shall be paid over to the general treasurer to be

14

made a part of the restricted account. The restricted account shall be used for the improvement of

15

social, recreational, and educational programs, including the purchase of educational and

16

recreational supplies and equipment for the welfare of members and for operational expenses and

17

capital improvements at the veterans' home and veterans' cemetery, as deemed necessary by the

18

director of human services.

     (c) Notwithstanding the provisions of subsection (a) of this section, there is hereby

3

established a restricted receipt account within the general fund of the state for the sole purpose of

4

the collection and disbursement of any grant, devise, gift, or bequest of real or personal property

5

that may be made for the use and benefit of the design, construction, and furnishing of a new

6

Rhode Island veterans home in Bristol. This account shall be known as "donations -- new

7

veterans' home construction".

     (d) Notwithstanding the provisions of subsection (a) of this section, there is hereby

9

established a restricted receipt account within the accounts of the veterans' home for the sole

10

purpose of the collection of charitable donations made by veterans' groups and members of the

11

general public for the use of the residents of the veterans' home. This account shall be utilized for

12

activities to enhance the morale, welfare and recreation of the residents and shall be known as

13

"donations--chaplain's fund." The fund shall be maintained by the advisory council of veterans'

14

affairs established by §§ 30-24-3 and 30-24-4, which shall be responsible for establishing the

15

standing operation procedures of the fund, including, but not limited to, the authorization of

16

expenditures and an annual audit. Once the account is established, the director shall deposit any

17

and all funds held in any existing account under their control presently maintained for these

18

purposes into the newly established restricted receipt account.

     SECTION 2. This act shall take effect upon passage.

     This act would establish a restricted receipt account to collect charitable donations made

by veterans' groups and members of the general public for use regarding activities to enhance the

3

morale, welfare and recreation of the residents of the Rhode Island Veterans' Home designated as

4

the "chaplain's fund" maintained and operated by the advisory council of veterans' affairs.

5

     This act would take effect upon passage.
