	RELATING TO EDUCATION -- ESTABLISHMENT OF CHARTER PUBLIC SCHOOLS

	It is enacted by the General Assembly as follows:
1	SECTION 1. Chapter 16-77 of the General Laws entitled "Establishment of Charter
2	Public Schools [See Title 16 Chapter 97 - The Rhode Island Board of Education Act]" is hereby
3	amended by adding thereto the following section:
4	16-77-13. Moratorium on new charter public schools.
5	There is hereby imposed a moratorium on the creation of any new charter public schools
6	pursuant to this chapter until there is a revision to the foundation education-aid formula
7	established in § 16-7.2-3 that better reflects the needs of English language learner (ELL) students
8	and students with disabilities who are provided special education services.
9	SECTION 2. This act shall take effect upon passage.

	BY THE LEGISLATIVE COUNCIL

1	This act would create a moratorium on the creation of any new charter public schools
2	until there is a revision in the foundation education-aid formula to better reflect the needs of
3	English language learner (ELL) students and students with disabilities who are provided special
4	education services.
