It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Chapter 23-20.10 of the General Laws entitled "Public Health and |
2 | Workplace Safety Act" is hereby amended by adding thereto the following section: |
3 | 23-20.10-4.1. Electronic nicotine delivery system. |
4 | (a)(1) All words and phrases used herein shall be construed as set forth in § 23-20.10-2 |
5 | unless the context indicates otherwise. |
6 | (2) "Electronic nicotine delivery system" in addition to the definition stated in § 23- |
7 | 20.10-2, shall specifically include vape pens and vaporizers. |
8 | (3) All businesses that sell or distribute in any way electronic nicotine delivery systems |
9 | shall: |
10 | (i) Check the photo identification of every person under the age of twenty-seven (27) |
11 | years who attempts to purchase an electronic nicotine delivery system; |
12 | (ii) Only sell electronic nicotine delivery systems to customers age twenty-one (21) years |
13 | and older; |
14 | (iii) Not sell or distribute electronic nicotine delivery systems in a vending machine; |
15 | (iv) Not give away free samples to consumers of electronic nicotine delivery systems or |
16 | their components or parts; |
17 | (v) Not sell or distribute electronic nicotine delivery systems without a health warning; |
18 | and |
19 | (vi) Not display advertisements for electronic nicotine delivery systems without a health |

1 | warning. |
2 | (b) All violations of this section shall be subject to the sanctions set forth in § 23-20.10- |
3 | 10. |
4 | SECTION 2. This act shall take effect upon passage. |
