RELATING TO LABOR AND LABOR RELATIONS -- HOISTING ENGINEERS

     

     Introduced By: Representatives Quattrocchi, Nardone, Marszalkowski, Filippi, and Noret

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 28-26-14 of the General Laws in Chapter 28-26 entitled "Hoisting

Engineers" is hereby amended to read as follows:

     28-26-14. Persons and machinery exempt from chapter.

     (a) The provisions of this chapter shall not apply to engineers under the jurisdiction of the

5

United States, or engineers or operators employed by public utilities, and shall not apply to

6

agriculturists, fishers, horticulturists, and individuals utilizing their personal farm equipment

7

performing volunteer services on land trust property, or to any engine except one that operates a

8

hoist, shovel, crane, or excavator.

     (b) The provisions of this chapter shall not apply to powered industrial forklift trucks

10

commonly referenced as forklifts, pallet trucks, rider trucks, fork trucks, or lift trucks. Operators of

11

powered industrial forklift trucks (forklifts, pallet trucks, rider trucks, fork trucks, lift trucks) shall

12

be required to possess employer certification or third-party certification in general industry only.

13

This does not apply to the construction field. Operators of powered industrial forklift trucks, in the

14

construction field, shall be required to possess a Rhode Island State Hoisting Engineer's License

15

along with an operator's certification.

     (c) The provisions of this chapter shall not apply to non-commercial operators of motorized

17

trucks or equipment who are working within the borders of real property, they own, either in whole

18

or in part.

     SECTION 2. This act shall take effect upon passage.

BY THE LEGISLATIVE COUNCIL

     This at would exempt non-commercial operators of motorized trucks and equipment from

2

the requirements of the hoisting engineers' chapter, if they own, in whole or in part, the land upon

3

which they are working.

     This act would take effect upon passage.
