RELATING TO STATE AFFAIRS AND GOVERNMENT -- DEPARTMENT OF ATTORNEY

GENERAL

     It is enacted by the General Assembly as follows:

     SECTION 1. Purpose/Legislative Intent.

     The general assembly recognizes that crimes committed with firearms are and have been

3

the focus of legislative policy initiatives. In an effort to address such crimes, the legislature

4

understands that full disclosure of statistical data is essential to the proper formulation of effective

5

statutes. The general assembly recognizes that legislative initiatives are successful when all

6

pertinent statistical factors and data are available for consideration. Therefore, the annual gun

7

crimes law enforcement report is being amended.

     SECTION 2. Section 42-9-12.1 of the General Laws in Chapter 42-9 entitled

9

"Department of Attorney General" is hereby amended to read as follows:

     42-9-12.1. Annual gun crimes law enforcement report.

11

     (a) The attorney general shall annually, on or before March 31, make a report in writing

12

to the general assembly showing the transactions of the attorney general's office in relation to the

13

enforcement of law with respect to crimes involving a gun during the prior year ending on

14

December 31.

     (b) The report shall show for each of the counties of the state contain the total number of

16

non-warranted indictments and information cases with respect to crimes charges involving a gun

17

firearm in all courts in the state of Rhode Island pending filed at the beginning of during the

18

calendar year,. The report shall also contain all and the number of warranted indictments and

information cases with respect to crimes charges involving a firearm which have been disposed of

2

during the calendar gun pending at the beginning of the year, the number of indictments returned

3

and informations filed in these cases during the year, the number of indictments and informations

4

disposed of in these cases during the year:

     (1) By jury trial;

6

     (2) By jury waived trial;

7

     (3) Without jury trial on plea of guilty or nolo contendere; and

8

     (4) By a nol pros; and the number of non-warranted and warranted indictments and

9

informations pending at the end of the year.

     (c) The report shall also show the number of offenders in these cases punished by

11

sentence or imprisonment, or by the payment of a fine, or by both fine and imprisonment, or by

12

suspended or deferred sentence or probation, with the sentences and fines specified in each

13

instance.

     (d) The report shall be subdivided to show the sex of the offenders and the age of the

15

offenders, arranged by decades. by and specifically include each court docket number along with

16

the make, model number and caliber of the firearm utilized, involved and/or seized. The reported

17

firearm information shall also include if the firearm was stolen, altered or obliterated serial

18

numbers, and shall indicate if the firearm was a 3D printed firearm or ghost firearm. The report

19

shall be compiled using statistics provided by the Rhode Island statewide judicial information

20

system.

     SECTION 3. This act shall take effect upon passage.

     This act would require the office of the attorney general to issue a report containing the

2

total cases charged with a firearm in all Rhode Island courts and a list of cases charged with a

3

firearm which have been disposed during the calendar year. Said report would include the make,

4

model number and caliber of the firearm involved in said charges, and would also include if the

5

firearm was stolen, altered, or obliterated serial numbers, and indicate if the firearm was a 3D

6

printed firearm or ghost firearm.

7

     This act would take effect upon passage.
