A N   A C T

RELATING TO EDUCATION -- HEALTH AND SAFETY OF PUPILS

     

     Introduced By: Representatives Diaz, Slater, Bennett, Mendez, and Almeida

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 16-21 of the General Laws entitled "Health and Safety of Pupils" is

hereby amended by adding thereto the following section:

     16-21-8.1. School nurses.

     (a) Each school district may employ one or more licensed practical nurses certified by the

5

department of elementary and secondary education to assist the certified nurse-teacher employed

6

pursuant to the provisions of § 16-21-8.

     (b) Each school district shall employ no fewer than one certified nurse pursuant to the

8

provisions of § 16-21-8 or subsection (a) of this section for every seven hundred fifty (750)

9

registered students.

     (c) A school nurse may work on health related activities other than the practice of nursing

11

in a school district if time permits.

12

     (d) The director of the department of health in consultation with the commissioner of

13

elementary and secondary education shall promulgate rules and regulations to ensure that any

14

licensed practical nurse employed by or contracting with a public school district performs nursing

15

services under the supervision of a professional registered nurse or a licensed physician.

16

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would provide school districts may employ LPNs to assist certified nurse

2

teachers. The act also would require that no fewer than one nurse be employed for every seven

3

hundred fifty (750) students.

4

     This act would take effect upon passage.
