RELATING TO HEALTH AND SAFETY - EXPLOSIVES - NOTICE | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Section 23-28.28-37 of the General Laws in Chapter 23-28.28 entitled |
2 | "Explosives" is hereby amended to read as follows: |
3 | 23-28.28-37. Notice to adjoining landowners. |
4 | (a) Prior to the commencement of blasting operations, any person, firm, corporation, or |
5 | other entity that is regulated pursuant to the provisions of this chapter shall notify the owner or |
6 | owners of record of any improved real property within five hundred (500') feet, as measured from |
7 | the nearest borehole to the closest improved real property, of an intended blast or detonation, |
8 | excluding road, bridge, utility, and public works construction, no less than twenty-four (24) hours |
9 | prior to the blast or detonation. |
10 | (b) Notice shall also be given to any owner or owners of real property on which a structure |
11 | is located, which structure is located within five hundred feet (500') of the property line of the |
12 | property on which the blasting is to take place, and to the city or town council of the municipality |
13 | within which such property is located, no less than fourteen (14) days prior to the blast or |
14 | detonation. Quarries and mines authorized to operate shall be exempt from the requirements of this |
15 | subsection. |
16 | SECTION 2. This act shall take effect upon passage. |
