RELATING TO LABOR AND LABOR RELATIONS - MINIMUM WAGES

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 28-12 of the General Laws entitled "Minimum Wages" is hereby

amended by adding thereto the following section:

     28-12-3.3. Minimum wages for employees of developmental disabilities organizations.

     (a) Commencing October 1, 2020, every covered employer providing services to five (5)

or more persons with developmental disabilities, that are reimbursed for such services by the state,

shall pay to their employees, no less than fifteen dollars ($15.00) per hour. For the purposes of this

section, covered employers are those developmental disability organizations licensed to provide

services pursuant to § 40.1-24-3.

     (b) The state general revenues and federal funds appropriation(s) to the department of

behavioral healthcare, developmental disabilities, and hospitals (BHDDH) for services for the

developmentally disabled shall increase to programs that provide services to adults with

developmental disabilities in order to fund the minimum wage increase provided for in this section.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

     This act would require licensed employers providing services to at least five (5)

developmentally disabled persons that are reimbursed by the state, to pay employees no less than

fifteen dollars ($15.00) per hour and would require the appropriation of additional funds to cover

the cost of the increase.

     This act would take effect upon passage.
