A N A C T | |
RELATING TO THE TOWN OF WESTERLY -- PUBLIC PARKING COMMISSION | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Rhode Island public law, 1962, chapter 249, article IV, entitled "PUBLIC |
2 | PARKING COMMISSION" is hereby repealed in its entirety. |
3 | ARTICLE IV. PUBLIC PARKING COMMISSION |
4 | Section 1. The town council is hereby authorized to appoint a commission consisting of |
5 | five members to be known as the 'Westerly public parking commission'. |
6 | Sec. 2. Forthwith upon the passage of this act, the Westerly town council shall appoint |
7 | one member to serve until the first day of May, 1963, one member to serve until the first day of |
8 | May, 1964, one member to serve until the first day of May, 1965, one member to serve until the |
9 | first day of May, 1966, and one member to serve until the first day of May, 1967, and until their |
10 | respective successors shall be duly appointed and qualified. |
11 | In the month of April, 1963, and in the month of April annually thereafter, the Westerly |
12 | town council shall appoint one member of said commission to serve for a term of five years to |
13 | succeed the member whose term will then next expire. In the event of a vacancy occurring in said |
14 | membership, the Westerly town council shall appoint a member for the unexpired term. Any |
15 | member of the commission shall be eligible for reappointment. |
16 | At all times at least one member of said commission shall be a representative of retail |
17 | merchants and professions, at least one member shall be a representative of owners of |
18 | commercial real estate, and at least one member shall represent the consuming public. The |
19 | president of the town council shall be an additional member ex officio, of said commission. |

1 | Each appointed member of the commission before entering upon his duties shall take an |
2 | oath to administer the duties of his office faithfully and impartially. |
3 | The commission shall elect one of its members as chairman and another as vice chairman |
4 | and shall also elect a secretary who may or may not be a member of the commission. Three |
5 | members of the commission shall constitute a quorum and the vote of throe members shall be |
6 | necessary for any action taken by the commission. No vacancy in the membership of the |
7 | commission shall impair the right of a quorum to exercise all the rights and perform all the duties |
8 | of the commission. The members of the commission shall not be entitled to compensation for |
9 | their services. |
10 | Sec. 3. Said commission, in collaboration with the department of public works and such |
11 | other departments and officials of the town as it may deem necessary, shall formulate as |
12 | recommendations for presentation to the town council, plans as guides for the present and future, |
13 | provision of automobile parking facilities, properly integrated with present and proposed traffic |
14 | facilities, subject to alteration as necessary. The plans of automobile parking facilities shall |
15 | include recommended design and location of proposed parking facilities which may include |
16 | improved or unimproved lots, single or multi-storied garages, or other structures and accessories; |
17 | and shall further include estimates of costs of the various projects therein included, a construction |
18 | program, and recommended methods of financing. Where the inclusion in any proposed structure |
19 | of rental space for other than parking purposes is incidental and reasonably related to the public |
20 | use of the parking facilities and will materially reduce net public expenditures for such parking |
21 | facilities, such rental space may be included in the plan. |
22 | SECTION 2. This act shall take effect upon passage. |
