RELATING TO PUBLIC OFFICERS AND EMPLOYEES -- MERIT SYSTEM

     

     Introduced By: Senators Ciccone, Lombardo, and Lombardi

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 36-4-10 of the General Laws in Chapter 36-4 entitled "Merit System"

is hereby amended to read as follows:

     36-4-10. Changes in plan -- Notice of establishment of new positions.

     (a) Additional classes may be established and existing classes may be divided, combined,

5

altered, or abolished upon recommendation of the personnel administrator, recommendation by the

6

director after public hearing, and approval by the governor. This action may be initiated either by

7

the personnel administrator, the director, or on request of an appointing authority. Appointing

8

authorities intending to establish new positions shall so notify the personnel administrator, and

9

except as otherwise provided in this chapter, no person shall be appointed to or employed for a new

10

position until it has been properly classified as herein provided and an appropriate list established

11

therefor.

     (b) For existing classes that may be divided, combined, altered or amended, whenever such

13

class is advanced from one pay range to another, any employee currently serving in the affected

14

classification shall be advanced to the same step in the new pay range, with the same civic service

15

status and will retain their currently earned salary set consideration date.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would allow an employee in a class advanced from one pay range to another, to

2

maintain the same step in the new pay range, as well as the same civil service status and their

3

currently earned salary set consideration date.

4

     This act would take effect upon passage.
