RELATING TO INSURANCE -- CLAIM ADJUSTERS

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 27-10-7 of the General Laws in Chapter 27-10 entitled "Claim

Adjusters" is hereby amended to read as follows:

     27-10-7. Exemptions from examination.

     (a) An individual who applies for an adjuster license in this state who was previously

5

licensed as an adjuster in another state based on an adjuster examination shall not be required to

6

complete the examination. This exemption is only available if the person is currently licensed in

7

that state, or if the application is received within twelve (12) months of the cancellation of the

8

applicant's previous license and if the prior state issues a certification that, at the time of

9

cancellation, the applicant was in good standing in that state or the state's database records or

10

records maintained by the NAIC, its affiliates, or subsidiaries, indicate that the adjuster is or was

11

licensed in good standing.

     (b) A person licensed as an adjuster in another state based on an adjuster examination who

13

moves to this state shall make application within ninety (90) days of establishing legal residence to

14

become a resident licensee. No examination shall be required of that person to obtain an adjuster

15

license.

     (c) No examination shall be required of a person who holds a claims certification issued by

17

a national or state-based claims association with a certification program that consists of at least

18

forty (40) hours of pre-exam coursework, a proctored examination of sufficient length to adequately

19

determine the competency of the person, and twenty-four (24) hours of continuing education

required for certification renewals.

     SECTION 2. This act shall take effect upon passage.

BY THE LEGISLATIVE COUNCIL

     This act would exempt a person from an adjuster examination if they hold a national or

2

state-based claims certification issued by a national or state-based claims association, that requires

3

a minimum of forty (40) hours pre-exam casework, a competency examination and twenty-four

4

(24) hours of continuing education required for certification renewals.

5

     This act would take effect upon passage.
