A N   A C T

RELATING TO CRIMINAL OFFENSES -- WEAPONS

     

     Introduced By: Senators Nesselbush, Valverde, Lawson, Quezada, and Crowley

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 11-47 of the General Laws entitled "Weapons" is hereby amended

2

by adding thereto the following section:

3

     11-47-41.1. Firearms dealers -- Monthly report to superintendent.

4

     (a) Every firearm dealer and every person, business or entity licensed pursuant to § 11-47-

5

39, shall, on or before July 10, 2020, and every month thereafter, on or before the tenth day of each

6

month, submit in writing or electronically a report to the superintendent of the state police,

7

providing information regarding all firearms sold, transferred or delivered in the previous month.

8

     (b) The superintendent of the state police shall establish by rules and regulations, the

9

content, format, and manner of transmission of the report which shall, for each firearm, at a

10

minimum, include the following information:

11

     (1) Name of the firearm manufacturer;

12

     (2) Identity of the importer for foreign manufactured firearms;

13

     (3) The model;

14

     (4) Type of action;

15

     (5) Caliber or gauge; and

16

     (6) Serial number.

     (c) The report shall include, all firearm transfers recorded in the dealer’s register pursuant

18

to § 11-47-40 and transfers recorded in the dealer’s records to include private party transfers.

     (d) No report shall contain the name, address or identifying information of the purchaser

or transferee.

     (e) A violation of this section shall be punishable pursuant to § 11-47-26.

     SECTION 2. Section 11-47-41 of the General Laws in Chapter 11-47 entitled "Weapons"

4

is hereby amended to read as follows:

     11-47-41. Government firearm registration prohibited.

6

     Except for the reports submitted pursuant to § 11-47-41.1, no No government agency of

7

this state or its political subdivisions shall keep or cause to be kept any list or register of privately

8

owned firearms or any list or register of the owners of those firearms; provided, that the provisions

9

of this section shall not apply to firearms which have been used in committing any crime of

10

violence, nor to any person who has been convicted of a crime of violence.

     SECTION 3. This act shall take effect upon passage.

BY THE LEGISLATIVE COUNCIL

     This act would allow the state police to maintain a registry of firearms sold and require

2

every firearms dealer, person or other entity, to submit monthly reports to the superintendent of the

3

state police. The report would have to include the manufacturer, importer, model, serial number,

4

the type of firearm and its caliber or gauge.

5

     This act would take effect upon passage.
