RELATING TO LABOR AND LABOR RELATIONS -- HOISTING ENGINEERS | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Section 28-26-7 of the General Laws in Chapter 28-26 entitled "Hoisting |
2 | Engineers" is hereby amended to read as follows: |
3 | 28-26-7. Application for license -- Examination. |
4 | (a) Each person who desires to act as a steam, internal combustion engines, electric, or |
5 | compressed air hoisting engineer shall make application to the division for a license upon a form |
6 | furnished to him or her, submit a notarized list of work experience, have possessed for at least three |
7 | (3) years prior to filing of the application, a certificate of registration in full force and effect from |
8 | the department of labor and training specifying that person as a registered apprentice hoisting |
9 | engineer and the application of that applicant is accompanied with an affidavit or affidavits of his |
10 | or her employer or former employers or other reasonably satisfactory evidence showing that the |
11 | applicant has actually been engaged in hoisting work as an apprentice hoisting engineer in the state |
12 | of Rhode Island for six thousand (6,000) hours of on-the-job training during a three (3) year period, |
13 | which shall include the successful completion of one hundred twenty (120) hours of related |
14 | instruction at a training program recognized by the department of labor and training, and shall pass |
15 | an examination on the construction and operation of steam, electric, internal combustion engines, |
16 | and compressed air engines and machinery. The apprenticeship requirement shall only apply to |
17 | lattice crane and hydraulic crane licenses. Applications for examinations must be received fifteen |
18 | (15) working days prior to the examination date. |
19 | (b) Any person applying for a license and who knowingly makes any misstatement as to |

1 | his or her work experience or other qualifications shall be subject to the penalties provided for in ยง |
2 | 28-26-11. |
3 | (c) In addition to the requirements for submitting an application for examination, as |
4 | required in subsection (a) above, any person applying for a full license, a hydraulic crane license, |
5 | or a lattice crane license shall also be required to include a valid medical health card with their |
6 | application. A separate notarized statement shall also be attached to the application, and shall |
7 | contain all work related experience, including all equipment trained on and/or operated. |
8 | (d) In addition to the requirements for submitting an application for examination, as |
9 | required in subsection (a) above, any person applying for a construction forklift license or a full |
10 | license shall also be required to include a copy of their OSHA forklift certification with their |
11 | application. |
12 | SECTION 2. This act shall take effect upon passage. |
