RELATING TO HEALTH AND SAFETY -- EXPLOSIVES | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Section 23-28.28-37 of the General Laws in Chapter 23-28.28 entitled |
2 | "Explosives" is hereby amended to read as follows: |
3 | 23-28.28-37. Notice to adjoining landowners. |
4 | (a) Prior to the commencement of blasting operations, any person, firm, corporation, or |
5 | other entity that is regulated pursuant to the provisions of this chapter shall notify any abutter and/or |
6 | the owner or owners of record of any improved real property, in writing, by registered mail, within |
7 | five hundred (500') feet, as measured from the nearest borehole to the closest improved real |
8 | property, of an intended blast or detonation, excluding road, bridge, utility, and public works |
9 | construction, no less than twenty-four (24) hours two (2) weeks prior to the blast or detonation. |
10 | Notice shall also be sent to the local police and fire department and town fire marshal, and the |
11 | building and zoning offices of the town where the property is located. Provided further, the state |
12 | fire marshal is authorized to establish rules and regulations necessary to carry out the provisions of |
13 | this section. |
14 | (b) Exceptions to subsection (a) of this section shall be provided to any utility or public |
15 | works department acting in an emergency capacity that requires blasting operations and under such |
16 | conditions no less than twenty-four (24) hours' notice prior to a blast or detonation shall be required. |
