RELATING TO HUMAN SERVICES -- MEDICAL ASSISTANCE | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Chapter 40-8 of the General Laws entitled "Medical Assistance" is hereby |
2 | amended by adding thereto the following sections: |
3 | 40-8-33. Dental care - Coverage - Dental surgical centers. |
4 | The department of human services shall provide for medical assistance under this chapter |
5 | for payment of medical assistance for charges incurred, including any and all facility fees, |
6 | medications and anesthetics provided in conjunction with dental care that is rendered to a pediatric |
7 | or adult recipient: |
8 | (1) In a hospital or ambulatory surgical center; or |
9 | (2) In the office of an oral or maxillofacial surgeon or dentist who has obtained the |
10 | necessary and appropriate permit; provided that, the recipient has a dental condition that requires |
11 | hospitalization or general anesthesia as determined by the patient's treating provider. |
12 | 40-8-34. Operating room costs - Dental care. |
13 | The department of human services shall provide medical assistance under this chapter for |
14 | the recognition, adoption and payment of the new coding guidelines (G0330) and associated |
15 | average payment rate approved by the Centers for Medicare and Medicaid effective January 21, |
16 | 2023, for hospital operating room and related costs, including facility fees, for dental procedures. |
17 | Provided, further, that appropriate coding and fair payment for these services is crucial for the |
18 | continued allocation of hospital operating room resources to treat those with the most complex |
19 | cases in need of comprehensive dental care. |

1 | SECTION 2. Chapter 27-20.1 of the General Laws entitled "Nonprofit Dental Service |
2 | Corporations" is hereby amended by adding thereto the following sections: |
3 | 27-20.1-23. Dental care - Coverage. |
4 | Any nonprofit dental service corporation shall provide for payment of medical assistance |
5 | for charges incurred, including any and all facility fees, medications and anesthetics provided in |
6 | conjunction with dental care that is rendered to a pediatric or adult recipient: |
7 | (1) In a hospital or ambulatory surgical center; or |
8 | (2) In the office of an oral or maxillofacial surgeon or a dentist who has obtained the |
9 | necessary and appropriate permit; provided that, the recipient has a dental condition that requires |
10 | hospitalization or general anesthesia as determined by the patient's treating provider. |
