RELATING TO TOWNS AND CITIES -- LOW AND MODERATE INCOME HOUSING

     Introduced By: Representatives Chippendale, Rea, Nardone, Place, and J. Brien

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 45-53 of the General Laws entitled "Low and Moderate Income

Housing" is hereby amended by adding thereto the following section:

     45-53-16. Public transportation requirement.

     (a) Any municipality not provided with public transportation sufficient to extend to urban

service boundaries within the municipality shall be permitted to reduce the percentage of low- or

moderate-income housing required pursuant to this chapter from ten percent (10%) of the year

round housing units reported in the census to six percent (6%) of the year round housing units

reported in the census as defined in § 45-53-3(4).

     (b) The decision to issue the percentage reduction provided in this section shall be

determined by the approved monitoring agent.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would allow municipalities without public transportation extending to urban

service boundaries to reduce the low- or moderate-income housing requirements from ten percent

(10%) to six percent (6%).

     This act would take effect upon passage.
