RELATING TO PROPERTY -- HOMELESS BILL OF RIGHTS -- MANDATORY

MUNICIPAL EMERGENCY SHELTERS

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 34-37.1 of the General Laws entitled "Homeless Bill of Rights" is

hereby amended by adding thereto the following section:

     34-37.1-7. Mandatory municipal emergency shelters.

     (a) All cities and towns, which are entitled to receive additional school aid, based upon the

5

equalized weighted assessment valuation, established in ยง 16-7-21, shall be required to provide and

6

maintain at least one emergency shelter, with a minimum of ten (10) beds, open year round. The

7

cost of the shelter shall be borne by the host municipality.

     (b) For purposes of this section, an "emergency shelter" means a facility, whose primary

9

purpose is to provide temporary shelter for the homeless, which does not require occupants to sign

10

leases or has occupancy requirements.

     SECTION 2. This act shall take effect upon passage.

     This act would require all cities and towns that receive extra state school aid to provide and

maintain, at their expense, year-round homeless shelters with a minimum of ten (10) beds.

     This act would take effect upon passage.
