J O I N T   R E S O L U T I O N

TO AMEND THE MEDICAID SECTION 1115 DEMONSTRATION WAIVER REQUEST

     WHEREAS, The General Assembly enacted Chapter 12.4 of Title 42 entitled "The

Rhode Island Medicaid Reform Act of 2008"; and

3

     WHEREAS, A legislative enactment is required pursuant to Rhode Island General Laws

4

§ 42-12.4-1, et seq.; and

5

     WHEREAS, Rhode Island General Laws § 42-7.2-5(3)(i) provides that the Secretary of

6

the Executive Office of Health and Human Services is responsible for the review and

7

coordination of any Medicaid section 1115 demonstration waiver requests and renewals as well

8

as any initiatives and proposals requiring amendments to the Medicaid state plan or category II or

9

III changes as described in the demonstration, "with potential to affect the scope, amount, or

10

duration of publicly-funded health care services, provider payments or reimbursements, or access

11

to or the availability of benefits and services provided by Rhode Island general and public laws";

now therefore be it

     RESOLVED, That this General Assembly, in pursuit of a cost-effective consumer choice

14

system of care and one that promotes personal choice and community integration and the state's

15

goal of rebalancing long term supports and services in accordance with Rhode Island General

16

Laws § 40-8.9-9 and to ensure better access to home care services for older adults, adults with

17

disabilities, and children, approves the following proposal to amend the demonstration and directs

18

the Executive Office to propose any necessary Medicaid state plan amendment or other action to

19

increase reimbursement rates in both fee-for­service and managed care to a minimum of twenty

20

dollars ($20.00) an hour for direct care workers starting on July 1, 2023; and be it further

     RESOLVED, That the Secretary of State be and hereby is authorized and directed to

2

transmit duly certified copies of this resolution to the Governor of the State of Rhode Island and

3

to the Rhode Island Executive Office of Health and Human Services.

TO AMEND THE MEDICAID SECTION 1115 DEMONSTRATION WAIVER REQUEST

     This act would provide legislative approval for a proposal to amend a Medicaid section

2

1115 waiver request that would direct the Executive Office of Health and Human Services to

3

propose any necessary Medicaid state plan amendment or other action to increase reimbursement

4

rates in both fee-for-service and managed care to a minimum of twenty dollars ($20.00) an hour

5

for direct care workers starting on July 1, 2023.
