A N   A C T

RELATING TO HEALTH AND SAFETY -- STATE BUILDING CODE

     Introduced By: Senators Lombardo, DiPalma, Ciccone, Gallo, and Pearson

     Date Introduced: March 23, 2023

     Referred To: Senate Housing & Municipal Government

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 23-27.3 of the General Laws entitled "State Building Code" is hereby

amended by adding thereto the following section:

     23-27.3-129.4. Refrigerants.

     No provision of the Rhode Island building code, or any other law, regulation, or other

requirement in Rhode Island, may prohibit or otherwise limit the use of a refrigerant designated as

acceptable for use pursuant to and in accordance with the provisions of 42 U.S.C. 7671k; provided

any equipment containing such refrigerant is listed and installed in accordance with safety standards

and use conditions imposed pursuant to such designation.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

     This act would bring state law into federal compliance by prohibiting or otherwise limiting

the use of refrigerants designated as acceptable pursuant to 42 U.S.C. 7671k as long as the

refrigerant is listed and installed in accordance with the designated safety standards and use

conditions.

     This act would take effect upon passage.
