SECTION 1. There shall be presented to the qualified electors of the Town of Cumberland, at the next general election or special election for their approval or rejection, the following question:
"Shall there be created a Town of Cumberland Municipal Fire District?"
SECTION 2. The board of canvassers of the Town of Cumberland shall notify' the secretary of state of the result of the vote upon the question submitted.
SECTION 3. This act shall take effect upon passage.

(00-S 2122) (Substitute "A")
Mr. Speaker:
I hereby moves to amend (00-S 2122) (Substitute "A"), entitled "AN ACT RELATING TO COMMERCIAL FISHERIES," as follows:
By deleting all of the language after the enactment clause and substituting the following therefor:
SECTION 1. Chapter 20-4 of the General Laws entitled "Commercial Fisheries" is hereby amended by adding thereto the following sections:
20-4-1.3. NONRESIDENT OFFLOADING AND SALE PROHIBITION. - For the marine species, summer founder and scup, that has been allocated to the state of Rho,de Island through a quota system established by the Atlantic states marine fisheries commission or the national marine fisheries service, no nonresident and no vessel registered or documented outside the state of Rhode Island and owned by a nonresident shall offload and/or offer for sale summer flounder and scup against the quota allocated, unless otherwise specified in section 20-4-1.4 of this chapter.
20-4-1.4. NONRESIDENT EXEMPTION
CERTIFICATE. - The director shall accept the existing summer flounder exemption certificates established by the Rhode Island marine fisheries council. The director shall issue a summer flounder certificate to any floating trap fishery which would have qualified for said certificate prior to January 1, 1000. The director shall establish a certificate program for scup and may issue an exemption certification to a licensed commercial nonresident and named vessel for the offloading and/or sale of scup. The licensed commercial nonresident shall apply for an exemption certificate and satisfy the criteria established by the director for that certificate.
The following provisions shall apply to summer flounder and scup exemption certificates:
(a) An exemption certificate holder may replace the named vessel provided that the replacement vessel and the named vessel are owned by the same person;
(b) Only one vessel upgrade shall be allowed for each exemption certificate. Any changes in the characteristics of the replacement vessel shall not exceed a ten percent (10%) increase in length, gross registered tonnage (CRT), net tonnage (NT), and/or twenty percent (20%) increase in horsepower (HP) when compared to the vessel replaced;
(c) Certificates shall not be combined to create a larger vessel;
(d) An exemption certificate shall not be pledged, mortgaged, leased, encumbered in any way, transferred to any other person, attached, distrained, sold on execution of judgement, nor shall any property right be created.
SECTION 2. This act shall take effect upon passage.
