Dear Lieutenant Governor Fogarty:

Pursuant to Rhode Island General Laws Section 35-18-3 and Section 36-18-4, I hereby request the General Assembly's approval, on behalf of the State of Rhode Island to finance the projects described below through the issuance of capital leases as defined in the Act.

Although each discrete project may not meet the dollar limits identified in the Act we feel it is prudent and consistent with our capital budgeting policy to inform the Legislature of these planned issuances.

In each instance, certificates of participation would be issued for a maximum of 6 years. Lease payments would equate to the amount necessary to pay principal, interest and premium, if any, on the certificates. The actual amount of certificates issued may 'be less than the amounts shown. The rate of interest on the bonds would be established at market rates of interest then available for such bonds in either a public offering or private placement.

Estimates of interest costs reflect the 4.75% rate projected at the time the Governor's Capital Budget was published. Actual rates may be higher at the time of issue. It is estimated that the total costs of issuance of all issues are estimated to be less than $70,000.

Howard Center Telecommunications $3,460,000

The goal of the Howard telecommunications project was to provide reliable communications capabilities to all buildings at the Howard Complex in Cranston, RI by adding buildings to the Lucent Technologies Definity G3rV5 system installed at the Department of Corrections. It included the installation or reuse of voice and data cable infrastructure inside facilities and the installation of appropriate conduit, fiber optics and copper cable to connect the buildings together and was viewed as a public health and safety issue. In addition to Howard Complex proper, the RI National Guard headquarters and the RI Emergency Management Agency on Pontiac Avenue were added to the system to ensure reliable communication for daily operations as well as in emergency management situations. While the main goal was to ensure uninterrupted phone service for public safety, the project will help the State move forward with more advanced data exchange capabilities. Since internet access and transmission of data occurs via phone lines, this cabling infrastructure will allow for more advancements in the future for the agencies at the Howard Complex. The General Assembly was made aware of this project last year, and the FY 2000 enacted budget included $500,000 of debt service for this project within the Department of Administration. The proceeds will reimburse the internal service fund that financed the project outlays. Total lease costs over the life of the issue are estimated at $3,968,290, including $3,460,000 of principal, and $608,290 of interest (estimated at 4.76%). Center General Furniture Project Costs: $1,626,000

The Center General Renovation project will provide a new home for the Department of Labor and Training and 450 of its employees. The Department of Children, Youth and Families will, now occupy the space vacated by the Department at 101 Friendship Street. The capital budget reflected issuance of $2.6 million for furniture, which includes workstations complete with internal electrical wiring. The estimated total cost was $3.0 million, with $.6 million to be paid with agency resources. Inmates from the Correctional Industries Program are building and installing the workstations. The total cost of the furniture is now estimated to be $2.1 million, with $676,673 from agency resources based upon a $1.525 million principal amount, total lease costs are estimated to be $1,749,029, including $224,029 in interest at 4.76%

Other Obligations

There are two other financings that we plan to coordinate within the Department of Administration in order to streamline the processing of financing agreements and reduce financing costs. These reflect financings that would have been executed by the Department of Administration through its Purchasing division at the request of various state departments. The Department of Administration is attempting to solicit competitive bids on the financing components of these purchases.

Vehicle Leases Project Costs: $4,100,000
(maximum of $4,400,000)

In FY 1999, the Department of Administration advised state agencies that it intended to standardize vehicles purchased by the state agencies to allow for bulk purchasing twice a year. This would allow the State to secure better prices, and to eliminate the numerous individual lease agreements with various financing companies (GMAC, Ford Motor Credit) and meet the new CNG vehicle requirements. This spring we intend to execute our first bulk purchase and consolidated financing. This first issuance reflects a full year of purchases due to the delays in commencement of the new program. The total principal amount is now estimated to be$4.1 million, including approximately $2.0 million of equipment, which would have been financed directly by the Department of Transportation as part of their long-term equipment plans. The final principal will be determined by the actual cost of the items bid. Total debt service is on $4.4 million estimated to be $5,046,380, including $646,38 in interest at 4.76%.

The lease payments will be charged to the agencies' operating budgets, where the vehicle leases have been budgeted and paid in the past. To the extent these payments are now viewed as "debt service" they would be budgeted within the Department of Administration, including the Department of Transportation's capital leases. The purpose of this program is to consolidate purchases, that would have otherwise been procured separately and financed under varying agreements with multiple companies. The structure of this financing ensures a market rate at the time of issuance based upon the results of a competitive RFP process conducted last fall.

E-911 Equipment for Extended E-911

Primary Service Project Costs: $1,215,000

Last year, the E-911 Commission requested funds to allow for extended primary service. The plan recommended would require the capital costs associated with this project to be financed over a period of years. This cost is part of the Commission's operating budget. The Budget Office is seeking an alternative to the rate offered to the E-911 Commission by GE Capital by soliciting bids. The State should select the lowest cost option available.

Obligations

As indicated, the source of the payment for the Department of Administration lease would be subject to annual appropriations by the Rhode Island General Assembly. The sources of payment would depend upon the use of the asset (i.e. gas tax for DOT trucks, general revenue, federal, and other resources for DLT furniture). The maximum possible obligations of the State of Rhode Island would be that amount necessary to repay principal, amortized over a time period not to exceed 6 years, interest payable and redemption premium, if any.

As you know, I am a strong supporter of pay as you go capital financing, and would prefer to pay cash for all these acquisitions. Given our resources, and competing priorities, this was not a realistic option. These assets will be financed over five years, which in most cases is shorter than the useful life of the asset. I felt it was important, regardless of whether it is required under the provisions of the Rhode Island Public Corporation Debt Management Act, to apprise you of the efforts which will be made by the Administration with respect to securing tax exempt financing for these assets.
