(h) If the criminal background check reveals that the applicant has no criminal record, all fingerprint records shall be destroyed by the bureau of the criminal identification of the Rhode Island State Police, the local police department, and any other holder of said records."

"Provided further, that the state shall reimburse the city or town for each applicant fingerprinted a sum not less than fifty dollars ($50.00) and not to exceed one hundred dollars ($100) as compensation for police time required under this statute; and, provided further, that no local police department shall be obligated to provide any such records check unless a sum to pay said compensation is provided as a line item in the state budget; and, provided further, that the state shall indemnify, and defend, the members of the local police department, and the city or town, for any injury sustained by any person coming onto the grounds of the police department for such records check, and for any errors that may occur in the conduct of the records check."
