move to amend (01-H 6100) (Substitute A as amended) entitled "AN ACT MAKING APPROPRIATIONS FOR SUPPORT OF THE FISCAL YEAR ENDING JUNE 30, as follows;

(1) In Article 13, by amending Section 1 to read as follows;

In addition to the appropriations set forth in other articles and sections of the act, the sum of four million dollars ($4,000,000) is hereby appropriated out of any money in the treasury not otherwise appropriated to be expended during the fiscal year ending June 30, 2002 for the purposes set forth in this section. The departments of children, youth and families, elderly affairs, health, human services and mental health, retardation and hospitals are hereby authorized and directed to amend their contractual arrangements with certain provider agencies to allow for payment of a provider rate adjustment in fiscal year 2002. These arrangements shall include language that will require providers accepting the adjustment to dedicate the proceeds of the adjustment to compensation, including employee benefits, for direct care staff Language shall also be included that will provide for reporting by the provider to vet this dedication of proceeds, and to require reimbursement of any such proceeds that are not disbursed according to this requirement. The provider types that shall be included are; assisted living waiver programs, home based-services financed by the departments of elderly affairs and human services, including registered nurses, tic poal nurses, coed nursing assistants, homemembers, personal care attendants and behavioral health specialists; services financed by the department of mental health, retardation and hospitals, including developmental disabilities, mental health community providers and substance abuse providers; contractual residential and non-residential providers to the department of children, youth and families, as well as adoptive parents; department of health early intervention and community health providers; and, adult day care providers contracted to the department of elderly affairs or the department of human services.

(2) In Article 13, by deleting Section 2 in its entirety, and by renumbering all other sections accordingly.

(3) In Article 5, page 4, after line 13, by inserting the following; "Legislature Legislative Office Building 4,000,000 (4,000,000) 0"

(4) In Article 1, by amending all entries, subtotals, and totals accordingly.

I hereby move to amend (01-H 6100) (Substitute "A" as amended) entitled ''AN ACT MAKING APPROPRIATIONS FOR SUPPORT OF THE STATE FOR THE FISCAL YEAR ENDING JUNE 30, 2002", as follows;

(1) In Article 1, as amended, on page 9, between the category headings "Office of the Governor - General and ''Public Utilities Commission" by deleting the following language;

(i) The general assembly recognizes, finds and declares that it is the policy of the state of Rhode Island that the waters, harbors and ports of the State of Rhode Island are important resources, and further that any development of port facilities is to be done in a manner that is both economically feasible and environmentally acceptable.

(ii) To the extent possible, any funds appropriated by the General Assembly, in support of fiscal year 2002, for the purpose of conducting an environmental impact statement (EIS) regarding Quonset Point shall be first utilized to conduct the necessary economic feasibility study as part of the overall EIS. Such feasibility study shall include, but not be limited to, engineering and marketing considerations.

(iii) The Governor shall, as a part of the overall EIS project, consult on a regular basis with the leadership of the House of Representatives and the Senate, or their respective designees as to all respects of the said project."

(2) In article 1, as amended, on page 9, between the category headings "Office of the Governor -General Revenues" and "Public Utilities Commission" by inserting the following language;

"(i) The general assembly recognizes, finds and declares that it is the policy of the state of Rhode Island that the waters, harbors and ports of the State of Rhode Island are important resources, and further that any development of these resources is to be done in a manner that is both economically feasible and environmentally acceptable.

(ii) Any funds appropriated by the General Assembly in support of fiscal year 2002 for the purpose of preparing for a possible environmental impact statement (EIS) regarding Quonset Point and/or Davisville should be used to conduct thorough analysis of waterfront development options including port facilities and the cost/ benefit of investing state resources in such waterfront development. Specifically, this analysis should include the development of a project purpose and the development of a preferred alternative plan. Further, this analysis should explore a range of alternatives for achieving the project purpose based on the following;

(1) a market and economic analysis;

(2) preliminary engineering designs;

(3) screening of environmental and permitting issues associated with each alternative.

These funds, however, shall not be used for the application of permits nor to file an application for a federal environmental impact statement.

(iii) The governor shall consult on a regular basis with the leadership of the house and senate or their respective designees as to all aspects of this analysis. Further, the governor shall report the results of the analysis to the house and senate finance committees by April 1, 2002 including a detailed accounting of how the appropriation has been expended."

I hereby move to amend (01-S 324) (Substitute "A") entitled ''AN ACT RELATING TO MOTOR AND OTHER VEHICLES MIS CELLANEOUS RULES", as follows: On page 3, immediately following line 26, by adding the following language:

"(n) No law enforcement officer shall use subsections (f) or (g) as the basis for stopping a motor vehicle for other reasons, and no operator of a motor vehicle shall be requested to consent to a search by a law enforcement officer of his or her motor vehicle which is stopped soley for a violation of subsections (f) or (g). Any evidence obtained as a result of a search prohibited by this subsection shall be inadmissable in any judicial proceeding. A person may not be placed under arrest solely for a violation of subsections (f) or (g). Nothing contained herein shall be construed to preclude any search based upon any legally sufficient cause other than consent.'

Mr. President:

I hereby move to amend (01-H 6579 as amended) entitled "JOINT RESOLUTION RELATING TO APPROVING FINANCING OF WARWICK STATION, INCLUDING REVENUE BONDS AND OTHER EVIDENCES OF INDEBTEDNESS", as follows:

"WHEREAS, The Rhode Island economic development corporation is a public instrumentality of the State of Rhode Island (the "State"), created by the General Assembly pursuant to Rhode Island General Laws section 42-64-1 et seq. (as enacted, reenacted and amended, the "Act"); and.

WHEREAS, The Act declares, in part, that new industrial, manufacturing, recreational, and commercial facilities are required to attract and house new industries and thereby reduce the hazards of unemployment; and that unaided efforts of private enterprises have not met and cannot meet the needs of providing those facilities due to problems encountered in assembling suitable building sites, lack of adequate public service, unavailability of private capital for development, and the inability of private enterprise alone to plan, finance, and coordinate industrial, recreational, and commercial development; and.

WHEREAS, The Act further declares it to be the public policy of the state to furnish proper and adequate airport facilities within the state and to encourage the integration of these facilities so far as practicable; and.

WHEREAS, In furtherance of these goals, it is the policy of the state to retain existing industries and to induce, encourage and attract new industries through the acquisition, construction, reconstruction and rehabilitation of industrial manufacturing, recreational, and commercial facilities, as well as transportation, residential, environmental, utility, public service, institutional and civic and community facilities, and to develop sites for such facilities; and.

WHEREAS, The Act has empowered the Rhode Island economic development corporation to establish subsidiary corporations to exercise its powers and functions, or any of them, and, pursuant to such power, the Rhode Island economic development corporation has established the Rhode Island airport corporation to plan, develop, construct, finance, manage, and operate airport facilities in the state; and.

WHEREAS, The Act provides that the Rhode Island airport corporation shall have the power to purchase, take, receive, lease or otherwise acquire, own, hold, improve, use and otherwise deal in and with, real or personal property, or any interest therein, wherever situated; and.

WHEREAS, The Act also provides that the Rhode Island airport corporation shall have the power to sell, mortgage, lease, exchange, transfer or otherwise dispose of or encumber any project, (or in the case of a sale, to accept a purchase money mortgage in connection therewith) or to grant options for any such purposes with respect to any real or personal property or interest therein, all of the foregoing for such consideration as the Rhode Island airport corporation shall determine. Any lease by the Rhode Island airport corporation to another party may be for such part of the Rhode Island airport corporation's property, real or personal, for such period, upon such terms or conditions, with or without an option on the part of the lessee to purchase any or all of the leased property for such consideration, at or after the retirement of all indebtedness incurred by the Rhode Island airport corporation on account thereof, as the Rhode Island airport corporation shall determine; and.

WHEREAS, The Act authorizes the Rhode Island economic development corporation to borrow money and issue bonds for any of its corporate purposes; and.

WHEREAS, Pursuant to Rhode Island General Laws sections 35-18-3 and 35-18-4, the Rhode Island economic development corporation has requested the approval of the General Assembly for the Rhode Island economic development corporation's issuance of not more than one hundred seventy million dollars ($170,000,00) special purpose revenue bonds (the "Bonds") for the purpose of providing funds to the Rhode Island airport corporation for the financing the acquisition construction furnishing and equipping of the Warwick Station project, as defined below, funding capitalized interest costs of issuing the Bonds and related costs, and the establishment reserves for the project and the Bonds, including a debt service reserve fund; and.

WHEREAS, The Warwick Station project will be erected on land owned or to be owned by the state and leased to the Rhode Island airport corporation and the project will therefore be subject to the terms and provisions of the lease agreement between the state and the Rhode Island airport corporation; and.

WHEREAS, Before the issuance of the Bonds, the Rhode Island airport corporation will enter into agreements with rental car companies, and, it expects that receipts from such agreements and from a customer facility charge will provide adequate revenues so that the full faith and credit of the state, the Rhode Island economic development corporation, and the Rhode Island airport corporation will be unnecessary in order to issue and market the Bonds; and.

WHEREAS, The state has established the Rhode Island department of transportation to have responsibility for preparing short-range plans, project plans, and implementation programs for transportation and for maintaining an adequate level of rail passenger and freight services, including the administration of any financial or technical assistance which may be made available to operators of railroad transportation facilities and for carrying out the supervision of the state airport at Warwick (to the extent such responsibility has not heretofore been delegated to the Rhode Island airport corporation); and.

WHEREAS, The Rhode Island department of transportation is authorized to cooperate with the appropriate agencies of the federal government, this state, other states, and regional agencies in the planning, design, construction, operation, and maintenance of transportation facilities and programs; and.

WHEREAS, The Rhode Island department of transportation is authorized to apply for and accept funds from federal and regional agencies to carry out any of its functions, and to contract with the federal government and regional agencies concerning the use and disposition of those funds; and.

WHEREAS, Pursuant to Rhode Island General Laws sections 35-18-3 and 35-18-4, the governor has requested, on behalf of the Rhode Island airport corporation, the approval of the General Assembly for the Rhode Island airport corporation's obtaining a loan (hereinafter referred to as the "TIFIA loan") under the Transportation Infrastructure Finance and Innovation Act in an amount not more than seventy million collars ($70,000,000) for the purpose of reducing the amount of Bonds that must be issued or held outstanding; and.

WHEREAS, The cost of the project is anticipated to be not more than one hundred sixty million dollars ($160,000,000); and.

WHEREAS, The financing of the project will be accomplished through one or more loan agreements having the Rhode Island airport corporation as borrower, such agreement or agreements to require that the Rhode Island airport corporation make loan payments (but only from project revenues and such other funds and assets as the Rhode Island airport corporation may designate) in an amount equal to the debt service on the Bonds, the TIFIA Loan, or both, as the case may be;

Now, therefore, be it resolved and enacted by the General Assembly as follows:

SECTION 1. For purposes of this act,.

(a) "Additional TIFIA elements" shall mean the freight rail improvement project and the acquisition and construction of rolling stock and commuter rail facilities and equipment.

(b) "Bonds" shall mean special purpose revenue bonds issued by the Rhode Island economic development corporation for the purpose of financing the acquisition, construction, furnishing and equipping of the project, funding capitalized interest, costs of issuing the Bonds and related costs, and the establishment reserves for the project and the Bonds, including a debt service reserve fund.

(c) "TIFIA Loan" means any loan granted by or at the direction of the Federal Highway Administration to a participating agency for the benefit of the project or the additional TIFIA elements under the Transportation Infrastructure Finance and Innovation Act.

(d) "Warwick Station project" or "project" shall mean an intermodal ground transportation facility consisting of a train and bus station, a commuter parking facility, and a consolidated rental car facility, and an automated people mover system to connect that facility to the Bruce Sundlun terminal of the T.F. Green state airport; and related roadway improvements.

SECTION 2. The General Assembly hereby approves the Rhode Island economic development corporation's issuance of the Bonds in an amount not more than one hundred seventy million dollars ($170,000,000). The Bonds will be special obligations of the Rhode Island economic development corporation payable exclusively from loan repayments under a loan agreement with the Rhode Island airport corporation and from Bond proceeds, funds, accounts, and properties, and the proceeds thereof pledged therefor, and thus the Rhode Island economic development corporation's maximum liability will be limited to loan repayments received under the loan agreement and the aggregate amount of such other funds, accounts, properties, and proceeds. Total debt service on the Bonds is estimated to be four hundred eighty-eight million dollars ($488,000,00) in the aggregate based on an average interest rate of seven percent (7.00%) for Bonds financing the automated people mover, nine percent (9.00%) for other Bonds, and a thirty (30) year maturity. Such estimated debt service may be reduced to the extent that a TIFIA Loan is utilized as described below.

SECTION 3. The General Assembly hereby approves the taking by the Rhode Island airport corporation of a TIFIA Loan in an amount not more than seventy million dollars ($70,000,000) for the purposes outlined herein. The TIFIA Loan will be payable from project revenues and from proceeds, funds, accounts, and properties and the proceeds thereof pledged therefor. Total debt service on the TIFIA Loan is estimated to be two hundred three million dollars ($203,000,000) in the aggregate based on an average interest rate of seven and one-half percent (7.50%) and a thirty (30) year maturity.

SECTION 4. The General Assembly hereby approves the Rhode Island airport corporation's entering into the loan agreements described above. Payments under the loan agreements shall be derived exclusively from project revenues and such other proceeds, funds, accounts, projects and the proceeds thereof as the Rhode Island airport corporation may pledge therefor.

SECTION 5. None of the bonds, the TIFIA Loan, or the loan agreements shall constitute indebtedness of the state or a debt for which the full faith and credit of the state or any of its subdivisions is pledged.

SECTION 6. Chapter I -2 of the General Laws entitled "Airports and Landing Fields" is hereby amended by adding thereto the following sections:

**1-2-1.1. POWERS ELATING TO VEHICULAR TRAFFIC ACCESSING AIRPORT FACILITIES AT T.F. GREEN STATE AIRPORT. -- The Rhode Island airport corporation is authorized (1) to impose charges on customers of rental companies (as defined in section 31-34.1-1) who directly or indirectly use Warwick Station or the T.F. Green state airport, at such as the Rhode Island airport corporation may deem necessary to provide adequate revenue to pay all costs of constructing, reconstructing, expanding, reconfiguring, operating and maintaining Warwick Station regardless of whether such charges may have an anticompetitive effect, and (2) to regulate the access of vehicular traffic to airport properties including by excluding one or more classes of vehicular traffic from accessing portions of airport roadways, parking lots, curbsides and other vehicular facilities.

1-2-17.1. SALES TAXES AND SURCHARGES ON CUSTOMER FACILITY CHARGES. -- (a) Moneys due and payable to the state as sales taxes and rental vehicle surcharges on customer facility charges shall be deposited in a restricted receipt account entitled "receipts of sales taxes and surcharges on customer facility charges". The Rhode Island airport corporation shall provide to the Rhode Island department of administration information related to the amount of customer facility charges remitted on or before June 30 of each year.

(b) The amounts on deposit in the account for receipts of sales taxes and surcharges on customer facility charges shall be transferred to the city of Warwick as general revenues.

(c) "Customer facility charge" means the customer facility charge collected by rental companies (as defined in section 31-34.1-1) pursuant to regulations promulgated by the Rhode Island airport corporation. !!SECTION 7. The general assembly finds that the state airport provides substantial benefits to the people of the state beyond the city of Warwick as well as within the city of Warwick, but that the T.F. Green state airport imposes a significant burden on the city of Warwick not borne by inhabitants of the state beyond the city of Warwick. Furthermore, federal law prohibits the airport operator from paying taxes or making payments in lieu of taxes at a rate adequate to compensate the city and its inhabitants for that burden. The general assembly therefore finds it fair and appropriate to make appropriations to the city of Warwick from increased revenues to be received due to sales taxes and rental car surcharges collected in connection with the Warwick Station project.

SECTION 8. Section 31-34.1-2 of the General Laws in Chapter 31-34.1 entitled "Rental Vehicle Surcharge" is hereby amended to read as follows:

31-34.1-2. RENTAL VEHICLE SURCHARGE. -- (a) Each rental company shall collect, on each rental contract and at the time a motor vehicle is rented in this state, a surcharge equal to six percent (6.0%) of gross receipts per vehicle for each of the first ten (10) consecutive but is subject to the sales tax.

(b) The surcharge shall be included on the rental contract and collected in accordance with the terms of it. Fifty percent (50%) of the surcharge shall be retained by the rental company, and ((fifty percent (50%)!! **twenty-five percent (25%) of said surcharge!! shall **be remitted to the city of Warwick for its general use, and twenty-five percent (25%) of said surcharge shall !!be remitted to the state for deposit in the general fund. This remittance shall be made on a quarterly basis in accordance with a schedule adopted by the tax administration. Each rental company collecting and retaining surcharge amounts may reimburse itself from the funds retained for the total amount of motor vehicle licensing fees, title fees, registration fees, and transfer fees paid to the state, and for excise taxes imposed upon the rental companies' motor vehicles during the prior calendar year. However, rental companies shall not be authorized to reimburse themselves unless these fees and taxes have been assessed and paid in full to the state or appropriate city or town prior to any reimbursement. No reimbursement is allowed upon the prepayment of any fees or excise taxes.

(c) At a date to be set by the state tax administrator, but not later than February 15th of any calendar year, each rental company, in addition to filing a quarterly remittance form, shall file a report with the state tax administrator on a form prescribed by him or her, stating the total amount of motor vehicle licensing, transfer, title, and registration fees and excise taxes paid by the rental company in the previous year. The amount, if any, by which the surcharge collections exceed the amount of fees and taxes paid shall be remitted by the rental company to the state for deposit in the general fund.

SECTION 9. Section 44-4-4.1 of the General Laws in Chapter 44-4 entitled "Situs and Ownership of Taxable Property" is hereby amended to read as follows:

44-4-4.1. STATE PROPERTY TAXED TO LESSEE OR TENANT. -- **(a)!! Any property owned by the state, except land and piers but including any other read property, buildings, improvements, and tangible personal property attached to, contained in, or used in connection with the property, which is leased or ((RENTED **subleased!! for a term of ten (10) or more years, including any options to renew or extend the term, shall be taxed to the person, partnership, corporation, joint stock company, or association leasing or ((RENTING** subleasing!! the property, who, for the purposes of taxation is deemed the owner of the property; but excluding:

(I) Property acquired by the state from the United States pursuant to 50 U.S.C. App. section 1622(g) and managed for it by the Rhode Island port authority and economic development corporation;

(2) State property which is leased by any corporation, association, or organization which is exempt from property ** taxation, but the corporation, association or organization may in appropriate cases agree to make payments in lieu of taxes!!;

(3) State property which is leased for purposes of nonprofit public use or service;

(4) Portions of buildings which are owned by the state, the portions being of a size, shape, or other unique character which makes them impossible to measure or separate for purposes of taxation; and.

(5) State property leased for purposes which are necessary to the operation of an airport.

**(b) If a tenant or subtenant of state property under a lease or sublease with a term of ten (10) years or more including any options to renew or extend the term, makes any improvements to the property, the improvements shall be taxable to the tenant or subtenant as the case may be regardless of whether the improvements immediately upon accession or subsequently shall become state property, unless the improvements or the tenant or subtenant are otherwise exempt from taxation.

(c) Any agreement to make payment in lieu of taxes shall not be subject to chapters 5 through 9 of this title unless the agreement expressly so provides. Taxes authorized on state property under subsection (a) or (b) of this section shall not be enforced by any distress, lien, sale or other execution on such property, but the tax may be enforced against other property of the tenant or subtenant as provided in chapters 5 through 9 of this title or, if so provided by the lease or sublease agreement, may be enforced against the tenant's interest in such property.

!!SECTION 10. Except as provided herein, this joint resolution and act shall take effect upon passage. Section 7 shall be effective July 1, 2001. Section 8 shall be effective July I, 2002. Section 9 shall apply to dates of assessment occurring on or after December 31, 2000. Section I and so much of section 3 as relates to section 1 shall apply to bonds and related loan agreements issued or entered into within one (I) year of the date of passage of this act. Section 2 and so much of section 3 as relates to section 2 shall apply to TIFIA loans and related loan agreements taken or entered into within three (3) years of the date of passage his act."
