I hereby move to amend (02-S 2379) (Substitute "A" as amended) entitled "AN ACT RELATING TO WORKERS' COMPENSATION - GENERAL PROVISIONS", as follows:

1. On page 2, lines 18-20, by deleting the new language, beginning with the word "For" and ending with the word "employees".

2. On page 3, line 25, by deleting the word "Whenever" and inserting in place thereof the words "Effective January 1, 2003, whenever".

3. On page 3, lines 28 and 29, by deleting the following language: "as well as a certificate pursuant to section 44-30-71.4".

4. On page 16, by deleting all of the new language on lines 24 through 32, and inserting in place thereof the following:

(b) In any case in which the employee or, in case of death, the administrator of the employee's estate neglects to exercise the employee's right of action by failing to file a lawsuit against such third person within two years after the injury, the self-insured employer or the employer's insurance carrier may so proceed and shall be subrogated to the rights of the injured employee or, in case of death, to the rights of the administrator to recover against such person, provided, however that no subrogation action shall commence unless at least twenty-six (26) weeks prior to the expiration of the two years the self-insured employer or the employer's insurance carrier has notified the employee or in the case of death, the administrator of the employee's estate, in writing by personal service or certified mail, that failure to commence such action within two years after the injury will operate as an assignment of the right of action to the self-insured employer or the employer's insurance carrier.

(c) If the self-insured employer or the employer's insurance carrier recovers from such other person damages or benefits, after expenses and costs of action have been paid, in excess of the amount of the lien as defined in this section, then any such excess shall be paid to the injured employee or, in the case of death, to the administrator of the employee's estate for distribution.

5. On page 17, line 2, by inserting the words ", to act on its behalf," following the word "insurer," the first time it appears.

6. On page 17, line 2, by deleting the words "to act on its behalf" following the word "self-insurer."

7. On page 17, line 4, by deleting the period and inserting in place thereof a comma.

8. On page 17, lines 5 and 6, by deleting the language beginning with "The unit reviews" and ending with "determined by the unit".
