I hereby move to amend (02-S 2740) (Substitute "A") entitled "AN ACT RELATING TO PUBLIC PROPERTY AND WORKS - PUBLIC-PRIVATE REDEVELOPMENT INITIATIVE ACT", as follows:

1. On page 1, line 16 after the words "services and infrastructure", by deleting the period "." and word "Thus" and substituting in place thereof the word "thus".

2. On page 3, line 28, after the word "chapter" by adding the following words: "However, no real property currently within the freeway line of the interstate shall be transferred to the board for sale, lease, or utilization pursuant to a public-private partnership, until the project area becomes available for redevelopment pursuant to the plan."

3. On page 5, line 13, after the words "shall be" by deleting the following language "utilized in a manner consistent with federal funding for the realignment of Interstate Rout 195, including deposit into a state infrastructure bank;" and substituting the following words in place thereof: "deposited in the Intermodel Surface Transportation Fund, as defined in section 35-4-11, to be used for activities eligible for funding under title 23 (Highways) - United States Code."

4. On page 6, line 28, after the first word "of" by adding the following words: "and the planned completion date for the".

5. On page 7, line 5, after the word "infrastructure" by adding the following words; "The Board shall also consider fair market value as defined in 23 U.S.C. section 156 and 23 CFR section 710.403. The Director of the Rhode Island Department of Transportation as a member of the Board shall issue a report to the Board on this subject relative to each individual application."

6. On page 7, line 31, after the words "superior court", by adding the following words: "Appeals should be subject to de novo review."

7. On page 8, line 23, after the words "et seq.", and before the word "and" by inserting the following words: ", The Management and Disposal of Property Act, Rhode Island general laws section 37-7-1 et seq.,"

Mr. President:

I hereby move to amend (02-S 2961) entitled "AN ACT RELATING TO ESTABLISHMENT AND EXTENSION OF GAMBLING ACTIVITIES", as follows:

By deleting all language following the enactment clause and substituting therefor the following:

"Section 1. A special commission be and the same is hereby created consisting of seven (7) members of the house finance committee; four (4) members shall be the chairpersons of the subcommittees of the house finance committees on health and human services, general government, public safety, and education; one (1) of whom shall be the deputy chairperson of the house finance committee; one (1) of whom shall be the chairperson of the house finance committee; and one (1) of whom shall be a minority political member of the house finance committee to be appointed by the chairperson of the finance committee; and seven (7) members of the senate finance committee to be appointed by the chairperson of the senate finance committee, one of whom shall be a minority member.

The chairperson of the house finance committee shall appoint one (1) of the foregoing seven (7) members as the chairperson of the study commission, and the chairperson of the senate finance committee shall appoint the vice chair of the commission.

The purpose of said commission shall be to conduct a comprehensive study on the desirability of further gaming in Rhode Island, including full commercial casino gaming. The commission shall investigate, take testimony and gather evidence concerning the positive and negative aspects of further gaming. The commission shall consider potential locations of further gaming facilities, revenue sharing arrangements, casino partnership arrangements, and all other issues related to further gaming in Rhode Island.

Forthwith upon passage of this resolution, the members of the commission shall meet at the call of the chairperson of the house finance committee. Vacancies in said commission shall be filled by the chairperson of the house finance committee.

The membership of said commission shall receive no compensation for their services.

The commission may contract with individuals, colleges, universities, professional organizations or any other entities, or professionals with expertise which will assist the commission in its work.

All departments and agencies of the state shall furnish such advice and information, documentary and otherwise, to said commission and its agents as is deemed necessary or desirable by the commission to facilitate the purposes of this floor amendment.

The chairperson of the house finance committee is hereby authorized and directed to provide suitable quarters for said commission. The commission shall report its findings and recommendations to the house of representatives on or before April 1, 2003 and said commission shall expire on June 1, 2003.

In its report, the commission should set forth findings and/or make recommendations regarding, but not limited to, the following:

(1) What are the economic and social impacts, positive and negative, of authorizing additional gaming in the state;

(2) Whether the authorization of one (1) or more gaming facilities is desirable and beneficial to the state and, if so, what structure would maximize benefits to the state;

(3) Whether the establishment of one (1) or more commercial casinos in the state would cause significant social harm or any substantial economic harm to the state from lost state lottery income or other gaming revenue;

(4) Whether the economic benefits from the establishment of one (1) or more commercial casinos in the state would outweigh any potential social or economic harm which may result;

(5) If the establishment of new gaming facilities is determined to be in the state's best interest, whether such gaming facilities should be privately owned and operated, Indian owned and operated, or a combination of any of the foregoing;

(6) If the establishment of new gaming facilities in the state is determined to be in the state's best interest, whether such gaming facilities should include VLT-machine-only gaming, coin drop slot-machine and VLT-machine-only gaming, full casino gaming, modified casino gaming, or any other form of gaming;

(7) If the establishment of new gaming facilities in the state is determined to be in the state's best interest, whether existing gaming facilities should be allowed the same types of gaming as would be present in the new gaming facilities;

(8) If the establishment of new gaming facilities in the state is determined to be in the state's best interest, whether the state should mandate a competitive bidding process for any gaming facility in which the state is involved;

(9) If additional legalized gaming is authorized, what additional regulatory and administrative responsibilities and duties would be required and what regulatory structure would be most appropriate;

(10) If additional legalized gaming is authorized, what is the potential share for the state in the resulting new gaming revenue;

(11) Whether the study commission should recommend that a statewide referenda be put on the next ballot to allow the voters to determine whether gaming should be expanded in Rhode Island, and what question or questions should the voters be asked;

(12) What role should a host community play with any new gaming facility, including the degree of authority it should have over casino operations and the revenues to be obtained therefrom; and

(13) Whether any existing statutes regarding gaming and/or state lotteries should be introduced or amended.

Section 2. There shall be submitted to the qualified electors of the town of West Warwick, and the qualified electors of the state of Rhode Island, at least ten (10) days subsequent to the publication of the report of the special gambling commission, but in no event later than December 31, 2003, for their approval the following referendum question: 'Shall a gambling facility and/or activity be established in the town of West Warwick?'.

Section 3. This act shall take effect upon passage."

44-4-4.2 LEASEHOLD IMPROVEMENTS TAXED TO TENANT OF QUASI-PUBLIC CORPORATION. - Whenever real property is owned by a quasi-public corporation and leased to a tenant which is engaged in any business for profit, and such property is located at an airport with more than ten thousand (10,000) air carrier aircraft operations annually, any tax on leasehold improvements shall be paid by the tenant, who, for the purposes of taxation, shall be deemed to be the owner of any such leasehold improvements.

SECTION 2. This act shall take effect on July 1, 2001."
