I hereby move to amend (02-S 2548) (Substitute "A") entitled "AN ACT RELATING TO TOWNS AND CITIES - EMERGENCY POLICE POWER", as follows:
(1) On page 1, line 3, after "(a)" and before the word "Where" by deleting the word "Where" and by inserting the words "Notwithstanding any law to the contrary and consistent with the provisions of Chapter 40.1 of Title 45 entitled `Interlocal Contracting and Joint Enterprises', where".
(2) On page 1, line 5, after the word "agreement" and before the word "whereby" by inserting ", which is subject to approval by each city or town council by adoption of a resolution in support thereof,".
(3) On page 1, by deleting lines 11 and 12, and inserting in place thereof: "(c) All wage and disability payments, pension, workers' compensation claims, medical expenses or other employment benefits will be the responsibility of the employing agency, unless the requesting agency is reimbursed for such costs from any other source. Each agency shall be responsible for the negligence of its employees to the extent specific by law."
(4) On page 1, in between lines 12 and 13, by inserting the following language:
"(d) A copy of any agreement entered into pursuant to this section shall be provided to the Superintendent of the Rhode Island State Police.
(e) The governor shall have the authority to suspend an agreement entered into pursuant to this section upon a finding that the suspension is in the interest of public safety."
(5) On page 1, line 16, after the word "agreement" and before the word "with", by inserting: ", which is subject to approval by each city or town council by adoption of a resolution in support thereof".
(6) On page 2, by deleting lines 4 and 5, and inserting in its place the following:
