I hereby move to amend (02-S 2727) entitled "AN ACT RELATING TO INDEBTEDNESS OF TOWNS AND CITIES - MUNICIPAL DEFICITS", as follows:

(1) Page 3, line 19, by inserting the following language after line 19: "(f) The city or town council of each municipality within the state shall establish an audit committee comprised of not fewer than three (3) members of the city or town council, not more than one (1) of whom shall be a member of the council's finance committee, and at least one (1) other resident of the municipality with expertise and experience in public financing and/or public accounting. The audit committee of each city and town council shall meet at least quarterly; review all aspects of the financial affairs of the municipality, including current audits and any reports filed pursuant to this section; and report its findings and recommendations to the full city or town council."

(2) Page 4, line 23, by inserting the following language after line 23:

"SECTION 3. Section 16-2-9 of the General Laws in Chapter 16-2 entitled 'School Committees and Superintendents' is hereby amended to read as follows:

16-2-9. GENERAL POWERS AND DUTIES OF SCHOOL COMMITTEES. - (a) The entire care, control, and management of all public school interests of the several cities and towns shall be vested in the school committees of the several cities and towns. School committees shall have, in addition to those enumerated in this title, the following powers and duties:

(1) To identify educational needs in the community.

(2) To develop education policies to meet the needs of the community.

(3) To provide for and assure the implementation of federal and state laws, the regulations of the board of regents for elementary and secondary education, and of local school policies, programs, and directives.

(4) To provide for the evaluation of the performance of the school system.

(5) To have responsibility for the care and control of local schools.

(6) To have overall policy responsibility for the employment and discipline of school department personnel.

(7) To approve a master plan defining goals and objectives of the school system. These goals and objectives shall be expressed in terms of what men and women should know and be able to do as a result of their educational experience. The committee shall periodically evaluate the efforts and results of education in light of these objectives.

(8) To provide for the location, care, control, and management of school facilities and equipment.

(9) To adopt a school budget to submit to the local appropriating authority.

(10) To adopt any changes in the school budget during the course of the school year.

(11) To approve expenditures in the absence of a budget, consistent with state law.

(12) To employ a superintendent of schools and assign any compensation and other terms and conditions as the school committee and superintendent shall agree, provided that in no event shall the term of employment of the superintendent exceed three (3) years. Nothing contained in this chapter shall be construed as invalidating or impairing a contract of a school committee with a school superintendent in force on May 12, 1978.

(13) To give advice and consent on the appointment by the superintendent of all school department personnel.

(14) To establish minimum standards for personnel, to adopt personnel policies, and to approve a table of organization.

(15) To establish standards for the evaluation of personnel.

(16) To establish standards for conduct in the schools and for disciplinary actions.

(17) To hear appeals from disciplinary actions.

(18) To enter into contracts.

(19) To publish policy manuals which shall include all school committee policies.

(20) To establish policies governing curriculum, courses of instruction, and text books.

(21) To provide for transportation services which meet or exceed standards of the board of regents for elementary and secondary education.

(22) To make any reports to the department of education as are required by the board of regents for elementary and secondary education.

(23) To delegate, consistent with law, any responsibilities to the superintendent as the committee may deem appropriate.

(b) Nothing in this section shall be deemed to limit or interfere with the rights of teachers and other school employees to collectively bargain pursuant to chapters 9.3 and 9.4 of title 28 or to allow any school committee to abrogate any agreement reached by collective bargaining.

(c) The school committees of each city, town, or regional school district shall have the power to bind their successors and successor committees by entering into contracts of employment in the exercise of their governmental functions.

(d) Notwithstanding any provisions of the general laws to the contrary, the requirement defined in subsections (d) through (f) of this section shall apply. The school committee of each school district shall be responsible for maintaining a school budget which does not result in a debt.

(e) The school committee shall, within thirty (30) days after the close of the first and second quarters of the state's fiscal year, adopt a budget as may be necessary to enable it to operate without incurring a debt, as described in subsection (d).

(f) In the event that any obligation, encumbrance, or expenditure by a superintendent of schools or a school committee is in excess of the amount budgeted or that any revenue is less than the amount budgeted, the school committee shall within five (5) working days of its discovery of potential or actual over expenditure or revenue deficiency submit a written statement of the amount of and cause for the over obligation or over expenditure or revenue deficiency to the city or town council president and any other person who by local charter or statute serves as the city or town's executive officer; the statement shall further include a statement of the school committee's plan for corrective actions necessary to meet the requirements of subsection (d). The plan shall be approved by the auditor general.

(g) Each school committee within the state shall establish an audit committee comprised of not fewer than three (3) members of the school committee, not more than one (1) of whom shall be a member of the school committee's finance committee, and at least one (1) other resident of the school district with expertise and experience in public financing and/or public accounting. The audit committee of each school committee shall meet at least quarterly; review all aspects of the financial affairs of the school district, including current audits; and report its findings and recommendations to the full school committee. SECTION 4. Section 16-3-11 of the General Laws in Chapter 16-3 entitled "Establishment of Regional School Districts" is hereby amended to read as follows: 16-3-11. SCHOOL COMMITTEES OF REGIONAL SCHOOL DISTRICTS - POWERS AND DUTIES. - (a) A regional school district established under the provisions of section 16-3-10 shall be a body politic and corporate with all the powers and duties conferred by law upon school committees and with the following additional powers and duties:

(1) To adopt a name and a corporate seal.

(2) To sue and be sued but only to the same extent and upon the same conditions that a city or town may sue or be sued.

(3) (i) To acquire by purchase, gift, or other means of transfer or by condemnation, land, and improvements within the district as a site for a school or schools. To acquire also by this method the rights of way and other easements as may be required in connection with the use of the site.

(ii) For the purpose of acquiring land by condemnation for the site, the regional district is given all the powers conferred upon cities or towns for the condemnation of land for school purposes by section 16-9-5; provided, that the amount of land taken by the committee may exceed five (5) acres but shall not exceed thirty (30) acres for any one building site. The description, plat, and statement of the land taken under this chapter shall be signed by the chairperson of the regional district school committee and filed in the records of land evidence as provided in section 16-9-6. The owners of land or any persons entitled to any estate or interest in it taken by the committee shall have the same right of petition, the right of jury trial, and all other rights under the provisions of sections 16-9-7 and 16-9-8.

(iii) Upon the filing of the description, plat, and statement of the land taken, the title to the land shall vest absolutely and in fee simple in the regional school district notwithstanding that any of the land taken is devoted to a public use, and the district, acting by and through the district committee and its duly authorized agents, may immediately enter and take possession of the land without any process of law required by statute or common law, and remove any or all buildings, property, or other impediments, and occupy, use, and improve the land for the purposes of this chapter notwithstanding any other provision of law.

(iv) The district, through its committee, is authorized and empowered to pay for the cost of acquiring land for the school site from the proceeds received from the sale of bonds issued pursuant to the provisions of this chapter, whether the property is acquired by purchase or by condemnation, or partly by purchase and partly by condemnation.

(4) To secure competent architectural and engineering services for the taking of surveys, the preparation of plans and specifications for the construction and equipment of a school or schools in the district, and to employ clerical assistance as may be necessary.

(5) To construct, furnish, and equip schools and improve the grounds upon which the schools are located and to make additions to the schools as may be needed.

(6) To make all contracts and agreements that may be necessary for the exercise of the powers vested in the district school committee by subdivisions (3), (4), and (5) of this subsection;

(7) To issue under its corporate name and seal bonds in serial form to an amount not exceeding the debt limits as described in this chapter. The bonds shall be signed by the chairperson and treasurer of the regional school district committee; the principal and interest shall be payable in any coin or currency of the United States that, at the time of payment, is legal tender for public and private debts, and the debt secured by the bonds shall be obligatory on the district to the same extent as other debts lawfully contracted by the district.

(8) To borrow temporarily and to issue temporary notes of the district, the proceeds of which shall be used only for the purposes set forth in subdivisions (3), (4), and (5) of this subsection. Each authorized issue shall constitute a separate loan. Each issue may be for a period of not more than three (3) years and notes issued for a shorter period may be refunded or renewed from time to time by the issue of other temporary notes maturing within the required period of three (3) years, provided, that the period from the date of issue of the original loan to the date of maturity of the refunding or renewal loans shall not be more than three (3) years. Temporary notes of the district shall be signed by the chairperson and treasurer of the regional district school committee, and may bear interest or be sold at a discount. The period and discount or interest rate and other particulars of the temporary notes shall be fixed by the district committee. The temporary notes and renewal notes, including interest or discount on the notes and the expense of preparing, issuing, and marketing the notes, shall, unless otherwise taken care of, be funded by the issue of serial bonds under the provisions of subdivision (7) of this subsection. The aggregate principal amount of temporary notes issued and outstanding under this subdivision shall not at any time exceed the sum of the serial bonds authorized to be issued.

(9) To incur temporary debt after the district school or schools are constructed and in operation in anticipation of revenue to be received.

(10) To apply for and receive, accept, and use any state or federal funds or assistance, or both, as may be provided, whether in the form of a grant or a loan, or both, on the same basis as other school districts, but subject to the provisions of this chapter; to receive, accept, and use any gift from private sources; to receive and disburse funds for any district purpose.

(11) To publish an annual report containing a detailed financial statement showing the total receipts and expenditures of the period covered by the report together with additional information relating to the maintenance and operating of the school or schools as may be deemed necessary by the regional district school committee.

(12) To engage legal counsel.

(13) To engage and employ a superintendent of the district who may also be a principal of a district school or schools on a contractual basis for either a definite or indefinite term as the regional school district school committee shall decide. The person employed shall have all the powers and duties imposed upon a superintendent of schools by law.

(b) The powers, duties, and liabilities of a regional school district as set forth in this chapter, together with any other powers and duties pertaining to school committees prescribed by the laws of this state and not inconsistent with the provisions of this chapter, shall be vested in and exercised by a regional district school committee organized in accordance with the terms of the agreement. The committee shall choose by ballot a chairperson from its membership. It shall also appoint a clerk and a treasurer who may be the same person, and who need not be a member or members of the committee. The treasurer shall receive and take charge of all money belonging to the district and shall pay all bills and indebtedness of the district that have been approved by the committee; provided, that expenditures, encumbrances, and accruals shall not in any fiscal year exceed the total revenue belonging to the district. Should the treasurer estimate that actual expenses may exceed total available revenue in any fiscal year, he or she shall notify the school committee and the superintendent of schools, and the chief elected officials of the cities or towns. Purchase orders or financial commitments shall not be authorized even on the order of the school committee unless it can be proven that there will not be an excess of expenditures, encumbrances, and accruals over revenues. The clerk and the treasurer shall give bond to the district in the sum and with the surety as shall be satisfactory to the committee and conditioned for the faithful performance of the duties of the office.

(c) Nothing contained in this section shall be construed to prohibit a regional district school committee from negotiating and contracting with school employees and teachers for services to be rendered in the ensuing fiscal years pursuant to chapters 9.3 and 9.4 of title 28.

(d) The regional district school committee shall annually cause an audit to be made of the accounts of the regional school district and on completion of each audit, a report shall be made to the chairperson of the committee.

(e) (1) Notwithstanding any provisions of the general laws to the contrary, the requirement defined in this subsection shall apply. The school committee of each school district shall be responsible for maintaining a school budget which does not result in a debt.

(2) The school committee shall, within thirty (30) days after the close of the first and second quarters of the state's fiscal year, adopt the budget as may be necessary to enable it to operate without incurring a debt, as described in subdivision (1) of this subsection.

(3) In the event that any obligation, encumbrance or expenditure by a superintendent of schools or a school committee is in excess of the amount budgeted or that any revenue is less than the amount budgeted, the school committee shall within five (5) working days of its discovery of potential or actual over expenditure or revenue deficiency, submit a written statement of the amount of and cause for the over obligation or over expenditure or revenue deficiency to the town council president and such other person who by local charter or statute serves as the city or town's executive officer; the statement shall further include a statement of the school committee's plan for corrective actions necessary to meet the requirements of subdivision (1) of this subsection. The plan shall be approved by the auditor general.

(g) The school committee of each regional school district within the state shall establish an audit committee comprised of not fewer than three (3) members of the school committee, not more than one (1) of whom shall be a member of the school committee's finance committee, and at least one (1) other resident of the regional school district with expertise and experience in public financing and/or public accounting. The audit committee of each school committee shall meet at least quarterly; review all aspects of the financial affairs of the regional school district, including current audits; and report its findings and recommendations to the full school committee."

1. By striking all of the language after the enactment clause and substituting therefor the following: "SECTION 1. Title 23 of the General Laws entitled "Health and Safety" is hereby amended by adding thereto the following chapter:

CHAPTER 19.15
THE RHODE ISLAND CESSPOOL PHASE OUT ACT OF 2002

23-19.15-1. SHORT TITLE. - This chapter shall be known and may be cited as the "Rhode Island Cesspool Phase Out Act of 2002.

"

23-19.15-2. LEGISLATIVE FINDINGS. - The general assembly hereby recognizes and declares that:

(1) There exists within the state the need to abate pollution caused by cesspools.

(2) It is estimated that there are currently fifty thousand (50,000) cesspools within the state.

(3) Cesspools are a substandard and inadequate means of on-site sewage treatment because they overload the capacity of the soil to treat pollutants and frequently fail hydraulically.

(4) Cesspools contribute directly to ground and surface water contamination, contributing among other contaminants, nutrients and pathogens to the waters of the state.

(5) Cesspools degrade water quality and have been identified as a source of pollution in such environmentally sensitive areas as Greenwich Bay, the coastal salt ponds, and other water resources by not adequately treating sanitary sewage.

(6) Appropriate treatment of sanitary sewage reduces contamination risks to the groundwater and therefore risks to public health and the environment and restoration costs associated with groundwater contamination.

(7) Appropriate treatment of sanitary sewage is essential to the protection of groundwater, from which drinking water is derived, and, reduces the risks associated with the degradation of the state's coastal ponds and other water bodies where groundwater is the primary source of freshwater for these waterbodies.

(8) Advanced treatment of sanitary sewage, such as nitrogen-removal septic systems, further protects drinking water and groundwater and reduces the risks associated with the degradation of the state's coastal ponds and other water bodies where groundwater is the primary source of freshwater for these waterbodies, and also aides in the reduction of contamination risks to groundwater and restoration costs associated with groundwater contamination.

(9) Risks associated with cesspools have been acknowledged at the federal level including the facts that: (i) cesspools do not treat sanitary sewage and the effluent contains nitrates, total suspended solids and coliform bacteria; (ii) the effluent may contain other constituents of concern such as phosphates, chlorides, grease, viruses and chemicals used to clean cesspools (e.g. trichloroethane and methylene chloride); (iii) the wastewaters from cesspools frequently exceed drinking water health standards for certain contaminants; and (iv) areas that rely on cesspools are more likely to rely on groundwater for their drinking water supplies.

(10) A fund exists to assist homeowners with the costs of replacing cesspools and inadequate septic systems with an approved ISDS if the community in which the homeowner resides has created a wastewater management district in accordance with chapter 45-24-5.

23-19.15-3. DECLARATION OF PURPOSE. - The purpose of this chapter is to phase out use of cesspools within the state.

23-19.15-4. DEFINITIONS. - (a) Cesspool. Cesspool is defined as "any buried chamber," including, but not limited to, any metal tank, perforated concrete vault or covered hollow or excavation, which receives discharges of sanitary sewage from a building for the purpose of collecting solids and discharging liquids to the surrounding soil.

(b) Department. The department of environmental management as established in chapter 42-17.1.

(c) Director. The director of the department of environmental management or his or her designee.

(d) Failed cesspool. A cesspool where one (1) or more of the following conditions exist: (1) the cesspool fails to accept or dispose of sewage, as evidenced by indicators of sewage at the ground surface above or adjacent to the cesspool, or in the building served; (2) the cesspool extends below the seasonal high groundwater elevation; (3) pumping is required more than four (4) times a year; or (4) the cesspool is shown to have contaminated a drinking water well or watercourse.

(e) Individual sewage disposal system ("ISDS"). ISDS is defined as any piping, tanks, disposal areas, alternative toilets or other facilities designed to function as a unit to convey, store, treat and/or dispose of sanitary sewage, by means other than discharge into a public sewer system, that is approved by the department of environmental management.

(f) Watercourse. Watercourse is defined as Narragansett Bay and its tributaries, coastal and freshwater ponds, perennial and intermittent streams, vernal pools, coastal and freshwater wetlands.

23-19.15-5. CESSPOOL REMOVAL. - Cesspools shall be properly abandoned and replaced with an approved ISDS or tied into a public sewer system in accordance with the following risk based schedule:

(1) All cesspools within one hundred feet (100') of any drinking water well, or any watercourse, or drain that is likely to intercept groundwater flow from the location of the cesspool, must be properly abandoned and replaced with an approved ISDS by December of 2007.

(2) All cesspools between one hundred and two hundred feet (100' and 200') of any drinking water well, or any watercourse, or any drain that is likely to intercept groundwater flow from the location of the cesspool must be properly abandoned and replaced with an approved ISDS by December of 2012.

23-19.15-6. WAIVER. - The director may grant a waiver, to the extent necessary, from applicable provisions listed in section 23-19.15-5, provided, the homeowner demonstrates undue hardship and the cesspool is not a failed system as defined herein. At no point in time, shall any waiver of the requirements of section 23-19.15-5 be extended beyond December 31st, 2015.

23-19.15-7. EXEMPTION. - The risk-based cesspool replacement schedule set forth in this chapter shall not apply to any cesspool:

(1) located in a community that has adopted an on-site wastewater management ordinance that requires the risk-based phased-in removal of cesspools by December of 2020, or;

(2) serving a building on property in an area that has been designated by the municipal wastewater facilities plan to be sewered no later than five (5) years after the applicable deadline provided in section 23-19.15-5, provided: (i) it is not a failed cesspool as defined herein; (ii) the owner does not increase the design sewage flow in the cesspool or add bedrooms; (iii) the municipality holds bonding authorization or some other dedicated financial surety for expansion of sewers to the area of the building served by the cesspool; and (iv) the property owner certifies, in writing, that the dwelling/building will be connected to the sewer system within six (6) months of receipt of the notification to connect to the sewer system.

23-19.15-8. NOTICE TO REMOVE CESSPOOLS. - (a) The director shall require the removal of cesspools as set forth in this chapter. The owner of any cesspool which has not been properly abandoned and replaced with an approved ISDS as required by this act shall be in violation of this chapter and subject to enforcement action by the department in accordance with chapter 17.6 of title 42.

(b) Notwithstanding the above provisions, the director may require the abandonment and replacement of any cesspool with an approved ISDS if one (1) or more of the following conditions exist:

(1) a failed cesspool is indicated;

(2) if as a result of a watershed plan, such as a special area management (SAM) plan or a total maximum daily load (TMDL) study, a determination has been made that a cesspool within a particular geographic area must be abandoned and replaced earlier than as provided for in this chapter.

(3) the cesspool is a large capacity cesspool as defined pursuant to applicable federal regulations governing underground injection control (UIC) facilities.

23-19.15-9. REGULATIONS. - The department may promulgate rules and regulations as may be necessary to implement and carry out the provisions of this chapter.

23-19.15-10. SEVERABILITY AND CONSTRUCTION. - The provisions of this chapter shall be severable, and if any court declares any phrase, clause, sentence, or provision of this chapter to be invalid, or its applicability to any government, agency, person, or circumstance is declared invalid, the remainder of the chapter and its relevant applicability shall not be affected. The provisions of this chapter shall be liberally construed to give effect to the purposes thereof.

SECTION 2. Section 5-20.8-2 of the General Laws in Chapter 5-20.8 entitled "Real Estate Sales Disclosures" is hereby amended to read as follows:

5-20.8-2. DISCLOSURE REQUIREMENTS. - (a) As soon as practicable, but in any event, no later than prior to signing any agreement to transfer real estate, the seller of the real estate shall deliver a written disclosure to buyer and to each agent with whom seller knows he or she or buyer has dealt in connection with the real estate. The written disclosure shall comply with the requirements set forth in subsection (b) and shall state all deficient conditions of which the seller has actual knowledge. Agent shall not communicate the offer of buyer until buyer has received a copy of the written disclosure and signed a written receipt of same. If buyer refuses to sign a receipt pursuant to this section, the seller or agent shall immediately sign and date a written account of the refusal. The agent is not liable for the accuracy or thoroughness of representations made by seller in the written disclosure or for deficient conditions not disclosed to the agent by the seller.

(b) (1) The Rhode Island real estate commission may approve a form of written disclosure as required under this chapter or the seller may use a disclosure form substantially conforming to the requirements of this section. The following provisions shall appear conspicuously at the top of any written disclosure form: "Prior to the signing of an agreement to transfer real estate (vacant land or real property and improvements consisting of a house or building containing one to four (4) dwelling units), seller is providing buyer with this written disclosure of all deficient conditions of which seller has knowledge. This is not a warranty by seller that no other defective conditions exist, which there may or may not be. Buyer should estimate the cost of repair or replacement of deficient conditions prior to submitting an offer on this real estate. Buyer is advised however not to rely solely upon the representation of seller made in this disclosure, but to conduct any inspections or investigations which buyer deems to be necessary to protect his or her best interest." Nothing contained in this section shall be construed to impose an affirmative duty on the seller to conduct inspections as to the condition of this real estate.

Any change to requirements shall be a rule change, subject to the administrative procedures act. The power of the commission to amend the written disclosure requirements are liberally construed so as to allow additional information to be provided as to the structural components, housing systems, and other property information as required by this chapter."

I hereby move to amend (02-S 2981 as amended) entitled "AN ACT RELATING TO WATERS AND NAVIGATION - PERSONAL WATERCRAFT SAFETY ACT", as follows:

By renumbering SECTION 2 as SECTION 3 and adding the following language on page two after line 5.

SECTION 2. Section 46-22-9.8 is amended to read as follows:

46-22-9.8. CERTIFICATE OF BOATING SAFETY EDUCATION. - (a) No person born on or after January 1, 1986 shall operate a vessel that is fitted with propulsion machinery of more than ten (10) horsepower on the waters of this state unless the person shall have successfully completed a boating safety education program as approved by the director of the department of environmental management.

(b) The content of acceptable boating safety education programs shall meet the minimum standards and guidelines and be approved by the National Association of State Boating Law Administrators (NASBLA). Acceptable programs shall include those NASBLA approved courses offered by the state, the United States Coast Guard Auxiliary, the United States Power Squadrons or any other course approved by the director.

(c) Instructors shall meet the minimum requirements as established by NASBLA and shall be certified by the state.

(d)

Upon completion of a boating safety course, a written test shall be administered under the direct supervision of a certified instructor. The test shall include at least twenty-five (25) questions, scored on a one hundred percent (100%) scale, and have a passing grade of seventy percent (70%) or better. Test results shall be maintained by the department of environmental management, division of enforcement.

(e) The department shall issue a durable certificate of completion that meets the NASBLA guidelines. The certificate of completion shall be presented upon request of any authorized law enforcement officer to show proof of compliance.

(f) A challenge exam, meeting the standards of subsection (d) of this section proctored and administered by a certified instructor, shall be made available to those individuals that wish to review the requirements of this section. The exam may be administered to a candidate two (2) times. Failure of the examination on the second attempt will require the candidate to retake and/or complete the same and/or a different boating safety education program as provided for in this section.

(g) (1) Any person having in his or her possession a certificate of completion of any boating safety course approved by NASBLA shall be considered to be in compliance with this chapter and can request that a certificate be issued by the department.

(2) The following persons shall be exempt from the educational provisions of this chapter provided that they can provide proof of exemption:

(i) A person who operates a vessel under training, directly supervised by a person on board the vessel who is eighteen (18) years of age or older and meets the requirements of subsection (a) of this section;

(ii) A person who holds a valid commercial vessel operator's license issued by the United States Coast Guard, a state, or a province;

(iii) Non-residents temporarily using the waters of this state who meet the requirements of their state of legal residence.

(3) New residents of this state will be given sixty (60) days to meet the requirements of this chapter.

(4) Boat liveries that rent out boats or vessels fitted with propulsion machinery greater than ten (10) horse power shall require all renters who do not comply with this section to watch a short instructional video approved by the director on boating safety for the type of craft rented, and pass a written examination.

(h) Any person born after January 1, 1986 operating a personal watercraft as defined in 46-22-2(6) on the waters of this state shall have successfully completed a boating safety education program as approved by the director of the department of environmental management.

(i) Any person who violates any provision of this section shall be sanctioned as follows:

(1) For a first offense completion of an approved boating safety course;

(2) For a second offense a fine not to exceed one hundred dollars ($100).
