Mr. Speaker:

I hereby move to amend (03-H 5844) entitled "AN ACT RELATING TO TOWNS AND CITIES" as follows:

1. On page 3, lines 25-29, by deleting all of the language appearing on such lines after the language "(a) Family Day Care Home. -" and substituting therefor the following language:

"Any home other than the child's home in which child day care in lieu of parental care and/or supervision is offered at the same time to four (4) or more children who are not relatives of the caregiver licensed by the state pursuant to section 42-72.1-2(10)."

2. On page 3, lines 30-34, and on page 4, lines 1-3, by deleting all the language appearing on such lines after the language "(b) Family Group Day Care Home." and substituting therefor the following language:

"A residence occupied by an individual of at least twenty-one (21) years of age who provides care for not less than nine (9) and not more than twelve (12) children, with the assistance of one or more approved adults, for any part of a twenty-four (24) hour day. The maximum of twelve (12) children shall include children under six (6) years of age who are living in the home, school-age children under the age of twelve (12) years whether they are living in home or are received for care, and children related to the provider who are received for care, and licensed by the state pursuant to section 42-72.1-2(11)."

3. On page 9, line 1, by deleting the language "This act shall take effect upon passage." and substituting therefor the following language:

"Section 45-24-37 of the General Laws in Chapter 45-24 entitled "Zoning Ordinances" is hereby amended to read as follows:

45-24-37. GENERAL PROVISIONS - PERMITTED USES. - (a) The zoning ordinance provides a listing of all land uses and/or performance standards for uses which are permitted within the zoning use districts of the municipality.

(b) Notwithstanding any other provision of this chapter, the following uses are permitted uses within all residential zoning use districts of a municipality and all industrial and commercial zoning use districts except where residential use is prohibited for public health or safety reasons:

(1) Households;

(2) Community residences;

(3) Family day care homes.;

(4) Family group day care homes.

(c) Any time a building or other structure used for residential purposes, or a portion of a building containing residential units, is rendered uninhabitable by virtue of a casualty such as fire or flood, the owner of the property is allowed to park, temporarily, mobile and manufactured home or homes, as the need may be, elsewhere upon the land, for use and occupancy of the former occupants for a period of up to twelve (12) months, or until the building or structure is rehabilitated and otherwise made fit for occupancy. The property owner, or a properly designated agent of the owner, is only allowed to cause the mobile and manufactured home or homes to remain temporarily upon the land by making timely application to the local building official for the purposes of obtaining the necessary permits to repair or rebuild the structure.

(d) Notwithstanding any other provision of this chapter, appropriate access for people with disabilities to residential structures is allowed as a reasonable accommodation for any person(s) residing, or intending to reside, in the residential structure.

SECTION 3. This act shall take effect upon passage."

By deleting all of the language after the enactment clause, and substituting therefore the following language:

"HOUSE RESOLUTION TO REQUIRE THE DEPARTMENT OF HEALTH AND TO STUDY THE EPIDEMIOLOGY OF SEPSIS AND TO REPORT ITS FINDINGS TO THE GENERAL ASSEMBLY

WHEREAS, Sepsis, with acute organ dysfunction, which is also known as severe sepsis, is the number one cause of death in the noncoronary intensive care unit with mortality rates ranging from twenty-eight percent (28%) to fifty percent (50%) or more; and

WHEREAS, More than seven hundred fifty thousand (750,000) Americans develop severe sepsis each year, which equals more than two thousand (2,000) new cases per day in the United States; and

WHEREAS, In sepsis, an individual's blood pressure drops precipitously, which results in shock, and major organ systems such as the kidneys, liver, lungs, and central nervous system, stop functioning normally; and

WHEREAS, A change in mental status and hyperventilation may be the earliest signs of impending sepsis; and

WHEREAS, The number of cases are expected to increase due to increased awareness and sensitivity for the diagnosis of the condition, the number of patients with compromised immune systems, the use of invasive medical procedures, the number of resistant microorganisms, and the growth of the elderly population; and

WHEREAS, The science of sepsis is better understood and the provider community now realizes that it is more than simple inflammation in response to bacterial infection; and

WHEREAS, There is currently one United States Federal Drug Administration approved treatment for severe sepsis. While this treatment improves outcomes in many cases, it is underutilized due to a lack of awareness among health care providers and the public as well as cost because of the lack of diagnosis coding and the absence of reimbursement through private and public insurance programs for treatment of sepsis; and

WHEREAS, Severe sepsis is a common and frequently fatal and expensive disease if left untreated; and

WHEREAS, It is necessary to develop information concerning the disease known as "sepsis". It is also necessary to establish a means to collect data concerning the incidence of sepsis in medical facilities licensed and regulated by the department of health to prevent the occurrence of the disease in patients in these facilities, and to ensure access to improved treatments for sepsis through education of health care providers, patients, and the public about this condition and its treatment; now, therefore be it

RESOLVED, That the department of health shall compile reports from hospitals, laboratories and physicians regarding information on sepsis, and post such reports on its website known as www.health.ri.gov; and be it further

RESOLVED, That the department of health shall study the epidemiology of sepsis in the state of Rhode Island from the years, 1988 to 2002, such study to be based on the methods used in the "Epidemiology of Sepsis in the United States from 1979 through 2000", as reported in the New England Journal of Medicine on April 17, 2003; and be it further

RESOLVED, That the department of health shall report the results of its study to the general assembly on or before September 1, 2003.
