I hereby move to amend (98-H 7870) (Substitute "A") entitled "AN ACT RELATING TO DEPARTMENT OF HEALTH TATTOOING AND BODY PIERCING" as follows:

By deleting all of the language after the enactment clause and inserting in place thereof the following:

SECTION 1. Section 23-1-39 of the General Laws in Chapter 23-1 entitled "Department of Health" is hereby amended to read as follows:

23-1-39. Tattooing. -- Tattooing and/or body piercing. -- (a) The director shall promulgate rules and regulations which provide minimum requirements to be met by any person performing tattooing and/or body piercing upon any individual and for any establishment where tattooing and/or body piercing is performed. These requirements shall include, but not be limited to, general sanitation of premises wherein tattooing and/or body piercing is to be performed and sterilization of instruments. These rules and regulations shall place emphasis on the prevention of disease, specifically including, but not limited to, transmission of viral hepatitis , B and/or human immunodeficiency virus (HIV) . , and bloodborne pathogens. The piercing of earlobes and/or the use of a mechanized pre-sterilized ear piercing system that penetrates the outer perimeter of the ear and/or earlobe shall not be subject to regulation under this section. The director of health shall issue sanitary and safety related guidelines for the performance of such activities.

(b) In addition, these rules and regulations shall establish procedures for registration with the department of health of all persons performing tattooing and/or body piercing , for registration of any establishment where tattooing and/or body piercing is performed, for regular inspections of premises wherein tattooing and/or body piercing is performed, and for revocation of the registration of any person or establishment deemed in violation of the rules and regulations promulgated under this section. An annual registration fee in the amount of fifty dollars ($50.00) shall be paid by any person or establishment registered under this section. All fees shall be deposited by the department as general revenues.

(c) A person may not tattoo or pierce any body part of a minor without the written notarized consent of the minor's parent or legal guardian, and an establishment may not serve a minor under the age of eighteen (18) unless the minor is accompanied by a parent or legal guardian. Every person who shall tattoo or perform body piercing on any minor under the age of eighteen (18), except as specifically allowed under this subsection, shall be guilty of a misdemeanor and, upon conviction, shall be imprisoned not exceeding one year or be fined not exceeding one thousand dollars ($1,000). Nothing in this section shall be construed as prohibiting the removal of tattoo markings from the body of any person of whatsoever age. The piercing of earlobes and/or the use of mechanized pre-sterilized ear piercing system that penetrates the outer perimeter of the ear and/or earlobe shall not be subject to regulation under this section.

(d) Any person performing tattooing and/or body piercing or who maintains an establishment where tattooing and/or body piercing is conducted without registration(s) for said activity or activities from the director, shall be guilty of a misdemeanor and, upon conviction, shall be imprisoned not exceeding one year or be fined not exceeding one thousand dollars ($1,000).

SECTION 2. Section 11-9-15 of the General Laws in Chapter 11-9 entitled "Children " is hereby repealed.

11-9-15. Tattooing of minors. -- Every person who shall tattoo any minor under the age of eighteen (18) shall be guilty of a misdemeanor and, upon conviction, shall be imprisoned not exceeding one year or be fined not exceeding three hundred dollars ($300). For the purposes of this section "tattooing" shall mean the practice of marking the skin with indelible patterns or pictures by making punctures and inserting pigments. Nothing in this section shall be construed as prohibiting the removal of tattoo markings from the body of any person of whatsoever age.

SECTION 3. This act shall take effect on January 1, 1999."
