I hereby move to amend (98-H 8283) (Substitute "A") entitled ''AN ACT RELATING TO LABOR
AND LABOR RELATIONS - TEMPORARY EMPLOYEE" as follows:

By deleting all of the language following the enactment clause and inserting in place thereof the following:

Section 1. Title 28 of the General Laws entitled "Labor and Labor Relations" is hereby amended by adding the following chapter:

CHAPTER 6.10


THE TEMPORARY EMPLOYEE
PROTECTION ACT


28-6.10-1. STATEMENT OF POLICY - It is hereby declared to be the public policy of the state to foster the employment of all individuals in the state including temporary employees working for any employment agency, placement service, training school or center, labor organization, or any other employee referring source and to safeguard their right to obtain and hold employment without discrimination.

28-6.10-2. DEFINITIONS - WHEN USED IN THIS CHAPTER: (1) "Employee" includes any individual employed by an employer but does not include any individual employed by his or her parents, spouse, or child, or in the domestic service of any person.

(2) "Permanent employee" includes any employee who works for a direct source of employment for a long-lasting or indefinite period of time.

(3) "Employment agency" includes any person undertaking with or without compensation to procure opportunities to work, or to procure, recruit, refer, or place employees.

(4) "Temporary employee" includes any person working for or obtaining employment pursuant to an agreement with any employment agency, placement service, training school or center, labor organization, or any other employee referring source.

(5) "Labor organization" includes any organization which exists for the purpose in whole or in part, of collective bargaining or of dealing with employers concerning grievances, terms of conditions of employment or of other mutual aid or protection in relation to employment.

(6) "Person" includes one or more individuals, partnerships, associations, organizations, corporations, limited liability companies, employment agencies, legal representatives, trustees, trustees in bankruptcy, or receivers.

28-6.10-3. TEMPORARY EMPLOYMENT PRACTICES - Employment agencies shall offer no less than equal pay to temporary and leased employees who are performing substantially equivalent work as permanent employees with due consideration of seniority, experience, skills, and qualifications.

28-6.10-4. JOB DESCRIPTION NOTIFICATION - Before any worker is given any new job assignment regardless if the assignment is with the same contracting company, employment agencies shall provide their employees with the opportunity to see and have a copy of a written notice that includes a job description with position classification, physical and skills requirements, information of job hazards and information pursuant to the provisions of the Rhode Island general laws chapter 28-21 entitled "Hazardous Substances Right-to-Know Act", anticipated pay rate, benefits, and schedule in a language the worker understands. A copy of the job description shall be kept on file by the employment agency and be available to the employees.

28-6.10-5. PENALTY FOR VIOLATIONS Employment agencies that violate the provisions of sections 28-6.10-3 and 28-6.10-4 shall be punished by a fine of two hundred dollars ($200) for the first violation, ($600) forasecond violation, and ($1,000) for each succeeding violation.

Section 2. This act shall take effect upon passage.
